AIBU to ask for full refund of newly purchased, and now broken down car?

I've had it less than a month. I think I understand that I have some rights under the Consumer Rights Act 2015.

Can any legal-types help me draft an email to the dealer, or AIBU to ask?!

It did come with three month warranty. I have lost confidence in the car now. It's in the garage who say it's working fine Hmm
Breakdown man said he thought the gearbox was faulty and not to let them for me off without replacing the actuator.

You do have rights as it was a trade sale. You even have a few under private —unless the seller is a shit—
I would go back to the seller, for the first step and try to get a refund.

Things should not be going so wrong on a just purchased vehicle.
Contact the dealer and see what they say Smile

yes take it back! I had a thread on this a while ago, I had the car 7 days and it broke down. I got a full refund.

ring citizens advice, they will tell you what to do, send letters, how to word things. x

You need to do this quickly if it is less than a month since you purchased it and you want to reject the car. I have done this myself and did get my money back.

You need to return the car within 30 days and you should be able to get a full refund. Do it via email or letter so you have a paper trail. If they don't cooperate, and you paid even a small deposit on your credit card, go to your credit card company and ask for a section 75 review.

Note that if you have used the car a lot since you got it, the garage is entitled to deduct milage of between 25 and 45p per mile in line with HMRC guidelines

Ok ridiculous question. Presumably I ask dealer first for refund then attempt debit card chargeback?

Write to them. Tell them you are rejecting the car. This is the law. You can reject within 30 days. But you have to do this quickly. Give them the letter by hand or send recorded delivery or ideally do both of these things. Do not get into a conversation with them. Be a broken record. The car is rejected and you want your money back.

I dealt with this for my ex.

The garage had a warrenty that didn't click on until the car had been purchased, for two weeks.

So they told my ex to wait and he'd get a new clutch etc, so a better car without the dealer losing money.

But yes, you can get a full refund.

can you get someone independent to look at it?

I got an independent garage to look at mine, he confirmed it was indeed fucked, and I took pictures of the error codes. The dealer I bought it from asked me to take it to their garage which I did but I informed them I already knew what was wrong with it and I was rejecting it regardless of what their garage said, as I had already had my own advice. They took it back.

Hmm. Reply says manager away so can't authorise. Also as car currently at garage being repaired, I can't now claim refund.
