WIBU to say this eBay item is not as described?

I bought a BNWT top from eBay. When it arrived it was obvious the tag belonged to a different garment, the reference numbers did not match the label and the size was overwritten in biro from a 16 to 20. It also smelled like it had been worn. The seller claims she bought it and it was too small so she just put it in a box with other stuff to sell.

In fairness the seller offered I can return it for a refund but I will keep the top and hopefully it will wash up just fine. I do feel though that I should take a star or two off the feedback as not quite as described. The seller is unhappy as she feels it is not her fault, and she has good feedback.

This is only an Asda George top but I can’t help feeling a bit ripped off having expected a new top and receiving a 2nd hand top with a doctored label.

Take the stars off but write an honest review stating you're happy to keep it. The odd 3 star review doesn't hurt a sellers rating and might make them think twice before selling as 'new with tags'

I had someone give a 3 star review of a wireless keyboard/mouse combo that 'would have been better if it had a USB wire connector cable'

Quite generous of you not to give 1 star, given the possible deception and doctored tags. Do you think maybe she bought it like that from a charity shop or Ebay before chucking it in a drawer and maybe she thought it was bnwt? Take photos of the tag and labels before you wash it in case of any dispute.

if OP washes the item she won't win a dispute (is my understanding; washing is taken as "you accepted this in condition it arrived").
Either return it for refund or don't; but shouldn''t give seller bad review if you don't let her try to fix it by giving a refund.

Probably have to open a SNAD case to get return postage paid for.

Sounds like she wanted to sell as Bnwt so wacked on another tag. Why would you feel guilty. It’s fraud.

I buy from eBay regularly. Items are usually higher priced for BNWT ( which is justified as it's not second hand ) personally I would have returned it at her expense to teach her that she can't rip people off.

I once bought a bra that was listed as BNWT, when it arrived it was bobbly & a little faded, it clearly had been worn previously. I emailed the seller stating it had clearly been worn quite a lot & all she replied was ' sorry you feel that way' I requested a return at her expense..... CF Confused

Nothing wrong with an honest review. If you’re happy to keep the top then do so. Do mention that the seller offered a refund and the review is based on the inaccurate description.

I don't bother with feedback really. I did get a negative rating for realising I had already sold something and refunding her. I thought that was petty.

As mentioned by lottielottielottie I am happy to pay more for a new item. If she had offered to refund a pound or two as a token to acknowledge the item being used then I think I would have been happy with that. But I won’t ask for that as it seems like blackmail.

It is ironic that the seller says she feels very disappointed that I would mark down her feedback, feels it is not her fault. Yeah well I feel a bit disappointed being sent a used top with fake tag on it and it definitely is not my fault!

Actually a 3-star can affect an seller's overall rating on eBay. It can also cause their listings not to get so many views. eBay are constantly messing sellers about and only need the slightest excuse to ensure that private sellers are penalised.
I think the seller should have offered you some money back. As she hasn't, I think you should suggest it. Not to blackmail her, but perhaps she hasn't even thought of that solution.
However, I also know that some buyers are only too happy to mark a seller down without totally realising how detrimental this can be if they only sell a few items each month.

To be fair to the seller, she did offer to take the item back, so I can see why she's a little irked that you are now threatening her with a lower overall feedback score. Sometimes, even with the best will in the world, mistakes happen. It would be nice if people understood this and maybe took a little time to think whether it's really worth ruining somebody's eBay score for a small value item.

If you want a partial refund then should ask that; don't mention Feedback when you ask her, just say "I would be happy with this purchase if you part refunded £1.50." *

It's pants to keep the item & not let her try to fix what you are unhappy about, tbh. If you're resolved to keep it, dock her stars & not ask for any further resolution, must state clearly in feedback that those were all your decisions not hers.

*I have to assume that a top from ASDA George only sold with about £1.50 net profit to seller, mind.

If its Asda/George you can confirm the doctored tag... the barcode is printed on the clothing tag, usually has ANA next to it

People get very upset if you mess up there 100% rating.

I once bought a dress that smelt of smoke when I opened the parcel but otherwise it was a lovely dress and high end high street brand which I didnt expect, fitted perfect. I gave a 4 star and very positive review with a small note about smell.... the abusivr messages from seller were awful I had to report to Ebay. Cant remember if they'd did anything though..

JellyBears, I know it seems odd to buy an Asda top from eBay. I have a very fat saggy tummy and their longer A line tops fit my shoulders and tummy and are long enough that my tummy is not hanging below the hemline of my top. I buy them online but often the larger sizes get sold out quickly so I sometimes pick them up on eBay. I was incredulous that anyone would fake a tag for an Asda top, hardly seems worth the effort.

I have attached a photo showing the tag and label. Looks like it was a size 16 changed to 20. I kind of feel unreasonable moaning about such a low value item but feel pissed off at the dishonesty more than the price.

WIBU to say this eBay item is not as described?
