So pissed at tax credits

I have three children all over 8 so before the new 2017 cut off I contacted tax credits to say partner moved in and they are saying they will only pay for 2 of the children. I don't really understand why according to their own website it's only children born after April 2017 that are excluded, before anyone mentions benfits nor a right I have always worked but have been made redundant due to health issues and partner moved in as he is undergoing cancer treatment and wasn't able to keep his own place going as he had to reduce hours.

I thought it was for any new claims after April 2017? So if you've added your partner it's been started as a new claim, therefore they'll only acknowledge two of your children now.

StormTreader · 18/12/2018 14:05

Its for new claims after that date, isn't it?

Bufferingkisses · 18/12/2018 14:07

Flamboyant is correct. Certain changed trigger a "new claim" at which point the rule is applied. Sorry, it stinks Flowers

They're wrong. You're right. Were you claiming tax credits within the last 6 months? If so, thwy should all be on your joint claim too.
You may need to do a mandatroy reconsideration.

You're right (as long as it definitely is a tax credit claim and not a UC one). The gov.uk page confirms it:

If you're making a new claim
Child Tax Credit is being replaced by Universal Credit.

You can usually only claim Child Tax Credit if you do not live in a Universal Credit area.

If you do live in a Universal Credit area, you can only claim Child Tax Credit if either of the following apply:

you have 3 or more children
you or your partner have reached Pension Credit qualifying age

If you cannot make a new claim for Child Tax Credit, you’ll usually need to apply for Universal Credit instead.

You can only claim Child Tax Credit for children you’re responsible for.

What you’ll get
The amount you could get depends on when your children were born.

If all your children were born before 6 April 2017
You could get the ‘child element’ of Child Tax Credit for all of your children.

Ask for a mandatory reconsideration.

You need to ask for a mandatory reconsideration (first stage of an appeal). They are wrong.

Thank for the advise I didn't realise I could ask for a consideration. It just seems horribly unfair I did the correct thing by reporting my change of circumstances and I'm being penalised for it. I think I'm more embarrassed than anything I always was very proud I provided for my children and now have to go cap in hand to my partner (who is awesome but should not be expected to do as much as he does for MY children) hopefully 2019 brings better things Smile
