Sorry to post this in here, hoping someone can help me as soon as possible. If my contract states I have a one month notice period and I wish to have my last day of employment as the 31st December, would I need to hand in my notice today or would it be tomorrow? Thanks!

Today. Most employers will be flexible though - if they are any good that is.

Depends how much leave you have left to use up

None at all. If I weren't handing my notice in I would be having to take unpaid leave over the Christmas shutdown

If you know you're definitely leaving, why not give them as much notice as possible? No-one is going to complain if you give them 1 month and 1 days notice. You don't have to hand in notice exactly 1 month to the day of leaving. That is just the latest you can give it.

Long story short (have many other threads about this) I'm on long term sick due to my employer not putting in reasonable adjustments. I know I definitely want to leave but in order to not have to pay back any annual leave I've already taken, I can't finish until the end of the year. I'm worried if I hand it in early they'll just tell me to leave early.

for your holiday leave calculation do you company run it from Jan 1 to Dec 31? a months notice for us from December 1 would be Jan 1 but we are not open that day, so you'd finish up December 30, cant make you work a day we are not open but you would be paid for calendar month

BlackrockMum · 30/11/2018 16:14

sorry realise my answer is a bit obtuse, if you wanted to finish up 31st yes we would expect your resignation today

PoesyCherish · 30/11/2018 16:16

Thanks @Blackrockmum the holiday year runs January 1st to Dec 31st. Christmas shutdown (ie nobody is in work or allowed to work due to lone worker policies etc) is 24th Dec to 4th Jan although we don't work weekends so first day back after shutdown would be the 7th Jan.

PoesyCherish, in that case would it not make more sense for you to hand in notice on the 6th? you might as well get paid for the first week of Jan, if you could manage it even do the 7th so you get a chance to say bye etc

PoesyCherish · 30/11/2018 17:00

Wouldn't I just not get paid though as I wouldn't have any annual leave entitlement? I wouldn't get chance to say bye anyway as I'm on long term sick.

it does depend on if the days you're shut from jan 1st to the 7th come out of your annual leave entitlement, we shut 5 or 6 days depends what days of week xmas is, but we only have to use 2 days entitlement, but our annual holiday leave runs from Feb 28. to Feb 27. ( this was to stop people forgetting to save the 2 days leave), I did notice you say you were on long term sick, just though you were possibly coming off it, - hence you had to leave , as no accommodations made by work, sorry just me jumping to assumptions that it may be possible to manage a day. i just always think its sad when people have to leave work like this .

Shoppingwithmother · 30/11/2018 17:30

You just write them a letter saying that you are leaving and your last day will be X. You don’t have to tell them exactly one month before, you just have to give them at least one month’s notice.

PoesyCherish · 30/11/2018 18:18

@BlackrockMum tbh I've got no strong feelings about going back for the day. I think I'd rather just leave (apart from the exit interview).

Thanks @Shoppingwithmother

I'll get on that now. Annoyingly I'll have to get another fit note in December as there's only 2 weeks left on it.
