Does anyone have any advice on the small claims court proceedure ? And the cost involved...? Is it complicated to bring a case?Any help greatfully recieved

I saw the initial fee structure but it seemed too easy if you know what I mean...After you file the paper work do you need to pay for the hearing? I worry when things seem so straightforward!!! I would be representing myself.

Mcol ,money claim online.
It's ridiculously simple and depending on the figure you are claiming will cost £40-£120.

It is easy.
I've done it once for myself and twice for friends.

Only one was defended by Thomas Cook which we ultimately won.
It's satisfying too Grin

I am only claiming a small amount of say £300 for goods or services not recieved

I’m currently going through the process.

You need to issue a Letter Before Action and give them reasonable time to pay. 14 days ish or 28.

Then submit your claim.

They have a few weeks to response. They say whether they are happy to try mediation.

You do or don’t have your one hour mediation. Then it takes 12ish weeks to be seen in court.

Yes. Google a Letter before Action, there are a lot of them freely available. Use the to make your own and send it.

Meanwhile register with MCOL. Registration is free. The instructions are really clear.

My debtor paid on receipt of the letter.

My friend won a case against a roofer, but although the court said he should pay she had to pay even more to get goods arrested as he wouldn't pay up. I think in the end he made our so hard to get anything she gave up. Sorry this isn't a happy story but just to warn you it's not as straightforward as winning your case.
