Not so much of a AIBU but just posting for traffic really.

I have just been offered a new job and am due to start in two weeks time. I have my induction next week where I just need to go in and sign some forms.

I was in another role for two years but that ended in December last year (2 year contract), I was then off for a couple of months just looking for something I would be happy in and found a job in February.

I worked there from the end of Feb to July of this year, however I absolutely hated it and only stuck at it as I was desperate for the money. I left abruptly in June due to a bereavement in the family (close member) and I was then on the sick for around a month. I was only paid Statutory Sick Pay as I wasn’t with them long enough to receive full time pay. As I never received a working contract from them, I left with no notice as I just couldn’t face going back (I did check it out legally and I haven’t broken any laws).

Now my issue is, I really think I have shot myself in the foot massively. I have not mentioned anything about this job, as they would not have provided me with a reference anyway. I didn’t purposely lie so to speak I just did not see the point in mentioning it. I was going through a bad time in my life and now I’m just ready to move on and get back into work.

Tbf, they did not provide me with a P45 (unless they did but it just got lost in the post or something), anyhow I never received one, so I will be taking my P45 from my December job instead. I’ve just realised, they will probably find out from my taxes.

My question is now, what do I do? Do I tell them now? And if so, how do I do that without looking like a complete and utter liar?, or do I just play dumb and hope for the best? I could say I was on a work trial (which technically I was as I never received a working contract) but after being there for 6 months would they believe me?

I realise I have made a huge mistake which could impact on my job offer, I just want to know how to correct it.

You do need to tell them otherwise it will look dodgy if they find out later. You also need a P45 from them.

I'm not really sure why you didn't tell them? I'm not really sure how you can account for it now either.

I should have mentioned it in the interview, it's just not on my CV that's all.

I just thought since I left so abruptly and obviously left them in a shit situation they would not give me a reference, and to be honest I didn't think it looked very good that I left so quickly (even though it was a family emergency).

It saids on the forms that I can either bring my P45 with me or if I don't have one they'll just set it all up for me. I'm going in for my induction next week, I guess I could just mention it then but try and play it down and say I was on a work trial. At least if I mention it it doesn't look like I'm hiding anything.

Would they be able to find out if I was on the sick?

I don't know what to do for the best really.

It was some temporary work that you did for cash flow while you looked for something like new job. You haven’t deliberately hidden it. It’s fine. You also don’t need the P45, you can fill in another form and the tax office will sort it (though you may end up on emergency tax for a few weeks while they do).

Unless you signed something saying you’ve detailed every bit of employment ever or something to that effect you’ll be fine.

If you don't have (or take) your P45 you will fill in a P46. Then tick section B, this is my only or main job. You may be taxed on a week 1 basis (for example 1145L X whereas normally it would be 1145L), but that isn't basic rate (BR) so not too bad.
The right or wrong of it I have no opinion but that's what will happen if you've no P45.

I think this depends on what you have told the new employer up to this stage - have you submitted a CV without the last company on? Have you actively concealed the fact that you worked for the company by claiming to be unemployed since Christmas for example. I think there’s a difference between omitting something and deliberately concealing something but a lot depends on what you’ve said to date. Some people might advise sitting tight and seeing what happens but I think I’d have to speak to my new line manager to discuss it with them prior to the start date because I wouldn’t want to have the fear of discovery hanging over me. If you suffered a bearevement surely that’s a legitimate reason for leaving a contract?

You’re overthinking it. You can just fill out the “HMRC new starter form” that includes a section for people without a p45. same as if you’d lost it.
Don’t panic.
It’ll go to payroll, not HR and the HMRC just send them the tax code to use. They don’t see how much you’ve earnt

Stop panicking OP.

A P45 from December 2017 relates to the previous tax year so won't be much use however offer it anyhow and they will ask you to complete a new style P46 new starter checklist instead, you need to tick 'this is now my only job'.

They won't know you have been 'on the sick'. They will set you up on the system and then your tax code will sort itself out once you're on the system and HMRC know which is done automatically.

P46's are no longer used, you have to provide your new employer with a few details such as...
Leaving date from last job, total pay and tax paid to date for the current tax year, any student loan deductions, your NI number etc. I think you'll have to own up you took a short term contract to pay the bills and left due to close family bereavement 4 months later. I dont think it will cause you too many issues. Although how did you explain the gap in employment?

It really isn’t a big deal. Just say you don’t have a p45 from your last job which was a stop gap where you had to leave abruptly due to a bereavement, and there’s an alternative form you can fill out instead. It is absolutely not something to worry about.

I wouldn't say I concealed the truth, I did say in the interview that I had done some ad-hoc work, I just didn't mention anything about the last job so they know I've worked since Christmas.

I might sound dumb here, would I not be able to take my P45 from my December job?

I've been on emergency tax before years ago in a different job as the employer didn't send my P45 through and it's such a pain. I'm not sure I can go a month without a proper wage, but if I have to I have to.

you will not need to take your previous December P45 as others have said it is last years tax, the new tax year started April 2018 and will finish in March 2019. Your new work will fill out all forms online and upload straight to the Inland Revenue, who will send a tax code out to them usually within 2 or 3 weeks, your emergency tax should be a minimal payment on top of your normal tax deduction. This will be sorted by the next pay packet you receive. Hope this helps

I really don't mean to drip feed, I've been receiving UC since September. Does that make any difference what so ever? I'm sure I'm probably panicking over nothing I just really need this job and don't want to screw it up.

There is no point whatsoever of handing in the December 2017 P45, it relates to the previous year.

On the new starter checklist you must tick box B to say that you have been in previous employment, you are not asked to provide any information about that employment. Hopefully the person processing the new starter list will not be someone who would have seen you CV or be likely to spot the discrepancy.
