Bailiffs took my car I use for work

I am have a single parent and I work for uber part-time but bailiffs have come and taken my car for an unpayed parking fine . I have been looking on websites and found out that if u have a taxi or u are a taxi driver they can't take ur car because its ur only means and way on of earning any money. And that they are meant to set up some sort of arrangement plan up where u can pay back any money owed on a weekly or monthly plan.

Bailiffs don’t need a court judgement.

Is there a cite for that ?

Since you do uber part time, your argument won't hold, will have to pay up.

Must be some parking fine if they've the car as collateral.

CuriousaboutSamphire · 29/10/2018 17:04

Is there a cite for that ? Smile

I'm giving in! Head has met wall and wall has won!

Some people seem to spout nonsense for the sake of seeing their words appear on the magic screen!

It has bugger all to do with offering any help!

"You aren't a taxi driver. Ubers aren't taxis. They have fought long and hard not to be recognised as such."

Uber is a 'private hire vehicle'.

UK Uber drivers are licenced minicabs. (UberEats is not licensed, however)

In other countries Uber drivers are not necessarily licensed, but in the UK they are.

So if you are an Uber driver you have a private hire licence, and the vehicle should not be taken away.

TantrumsAndBalloons · 29/10/2018 17:24

@samphire.
I didn’t think I did post in absolutes as you put it.
I think what happened was someone posted a link to say that the OP was vulnerable due to having a child and I said that’s not the case

However as you seem to know much more about what I posted and what’s true etc then carry on

The thing is, the amount of totally innaccurate misleading bulshit posted on these types of theads infuriates me. Mainly because I do actually know the enforcement legislation

But hey ho. I’ll just let the OP carry on believing all the nonsense because I’m wrong

"Uber normally have fairly rigorous minimum standards for cars if not for drivers so it is likely the car is worth more than the limit and therefore can be siezed."

The requirement is 2008 or newer with 5 seats, they accept perfectly ordinary cars.

I was paying of a previous parking fine I got through a arrangement payment plan. I never missed a payment and I called up every week to pay my payments on two occasions I did ask if there were any outstanding fines and I was told there was no outstanding fines on the system. On the day my car got taken called them up straight away and I was like why has my car been taken I haven't missed any payments. They said you haven't missed any payments we can see ur upto date and that you only have £46 to pay. But whats happened is that you've got a fine for a unpaid parking fine. I did say so why wasn't I made of this because I've been calling up every week to pay my payments. They said you should have had a letter I said I never received a letter which I never might have got miss placed in the mail or something. But how funny the day after my car was taken I received a formal notice letter. I said to them if I knew about this fine in time I would have setup another payment arrangement plan cos I setup a arrangement payment plan for the first fine I had and I was upto date with my payments so why wouldn't I setup another agreement and pay of this second fine.

Thankyou to those of you who tryed to help me with your knowledge and your kind words

GabsAlot · 29/10/2018 18:26

how would u not know you had a fine though-all the letters went missing you dont just get one

QuietContraryMary · 29/10/2018 18:31

lexus8mmb do you have a private hire licence? What car is it?

ForalltheSaints · 29/10/2018 18:44

No sympathy, especially if the fine was for parking in a place not permitted.

How many parking fines do you have and how much are they. The carpark where I work is run by a private company ans fines are £70 although this is greatly reduced if you pay in a certain time. However, I know from people trying to cancel them the company issue at least 3 letters asking for payment before taking it further. Taking a car to cover a relatively small fine sounds excessive

Caprisunorange · 29/10/2018 19:01

Repossessing a car for a parking fine is quite common actually, i used to work in the area which is how I know how awful bailiffs are

KlutzyDraconequus · 29/10/2018 19:01

Sounds like you'd better not be driving any more TBF.
Can't tell when you've parked illegally, can't tell when you've got fined, already have one fine for parking and still incurred a second due to not paying attention.
They've done you a favour.

Poloshot · 29/10/2018 19:18

A payment plan for a parking fine? Or is that a parking fine that's been left for ages and incurred charges?

Caprisunorange · 29/10/2018 19:20

Of course it is Hmm what do you think, they hold it at £40?!

Poloshot · 29/10/2018 19:23

Of course I don't, but then again I'd have paid the £40 or whatever it was and not had my car taken as payment over some second parking fine notice that 'got lost in the post'. People should take a bit of responsibility instead of oh that's terrible hun hope you're ok, when in fact stupid behaviour ends in consequences that you might not like.

Caprisunorange · 29/10/2018 19:24

Good for you, some people don’t have £40

Aprilsinparis · 29/10/2018 19:25

You should have paid your parking fine. No sympathy. It seems to me you have been sticking your fingers in your ears, closing your eyes and singing tra-la-la-la-lah.

Poloshot · 29/10/2018 19:28

In which case don't incur additional expense by ditching your car on private property or in some other unsuitable or prohibited area or do some more Uber driving to get the cash.

LB1291 · 29/10/2018 19:40

Some people are so cruel. I am sure you’ve learnt from this without invisible people being so unhelpful. He who is without sin and all that. Hope you manage to get this solved. Good luck Flowers

SLL · 29/10/2018 19:41

I must admit to being a bit confused by this post... @lexus8mmb - how much was the original fine that you have been paying it for weeks but still have £46 left? Where did you park that got you a fine in the first place?

Why did you keep asking if there were other fines? Odd thing to ask unless you repeatedly park where you shouldn't. Asking kind of implies you are expecting something? With regards to this second fine, you don't just get one letter and then the bailiffs turn up...

Something is not really adding up, I have RTFT but might have missed something?

Caprisunorange · 29/10/2018 19:51

My dad once misread a suspension and got 7 parking fines in one weekend. It happens to plenty of people

zenasfuck · 29/10/2018 20:02

Op get on to bailiffs debts and bills on Facebook
There is a form you can fill in to say you didn't receive notification f the fine

They will talk you through the process

MissQuad · 29/10/2018 20:04

jimmyhill Why do you have to be so horrible to OP? Do you know her situation? Angry
