To report my employer for computer misuse?

Long story short, I used to work for an absolute bully of a manager. She bullied all the team and all the team finally lodged formal grievances against her, documented by literally hundreds of pages of evidence.

Nothing happened, she had a slap on the wrist and then started up a tirade of retaliatory action, so myself and a colleague agreed a payoff to leave the company as our working condition was so bad

Fast forward a couple of weeks. I clear my work laptop to hand it back in and find that I can't access the Facebook profile, in order to delete it. I had to create an account in order to do my job and populate it with my own personal details and picture. (I literally had to. Facebook thought it was fake until I submitted ID) (I don't use Facebook outside of work so couldn't use that)

So anyway, I try to delete it but find someone has reset the password, and recovery phone number, to do this they must have accessed work emails, which is fair enough.

However. I am increasingly annoyed that there is a Facebook account with my name and picture on it that I can't remove. I've tried reporting it to Facebook but they've done nothing.

Given the company's inaction over the clear bullying case I'm going to assume they won't take this seriously either, but just a little research shows clearly this is a criminal offence and people have gone to prison for it!

What do I do? Do I speak to the police, I honestly think they've got more important things to do, I've spoken to HR but not heard anything .. thoughts please?

Get facebook to delete stuff or even answer a message is a nightmare. Is there any way you can access your work emails to reset the password n then delete? Or physically just go to your office n not leave until someone sorts it out? Like what are they planning to do with your profile?

I’d email HR again and say that if they don’t pass you the credentials within the next 5 days you’ll be reporting them to the police.

If that doesn’t get movement then that’s what you do.

I would come at this from a GDPR angle - your ex boss is misusing your personal data (name etc that you set Facebook account up with).

This must breach some GDPR regulations - here.

There are potentially massive fines for GDPR breaches.

Give ACAS a call and ask their advice about how to proceed.

Thanks all and agree you're all right. I can't access my emails, they were the first thing locked and can't access the building without a pass, the manager is completely paranoid and would have spent hours pouring over every email I've ever sent.

Agreed it's serious and warrants at the very least a GDPR investigation. I'll proceed with caution.

Report the Facebook profile as a fake. Send them proof of your identity and say the profile is impersonating you

Please don't mention GDRP unless you talk to someone who really understands it and its legal implications. Posters on MN are always crying about data breaches when there aren't any.

This is complicated because the work Facebook page belongs to your company, not you, and so does the email address that was linked to it and to your password.

Start with the obvious: contact HR or whoever arranged your departure and say your information must be removed from the Facebook profile. If that doesn't work I would send a few reminders and then, if it bothers you that much, get legal advice from someone who specialises in data breaches. Do not rely on MN.

I originally set it up as part of my job, and I did tell the head at the time it was technically not right, they didn't listen and insisted on it...

Agreed it's complicated but because there are no 'work' profiles strictly speaking, the profile does technically belong to me. Very complicated!
