'Separated' or not?

AIBU to say that if my DH has not lived with me (and our 17 year old son) for nearly four years; has no sexual or physical relationship with me and makes no financial contribution to household (the household comprising our son and me), I can consider myself 'separated'?

I am asking this because I have filled in a number of forms which ask my marital or cohabiting status and I have been a bit confused about whether to tick 'married' (which we are, legally) or 'separated'. The matter is complicated when some forms require details of 'spouse's' income etc. if the 'married' box is ticked.

Surely a category such as 'married but not living with the b*stard' could be added!

Yes, you can tick 'separated' on everything. Are you planning to divorce (sorry, that's nosy) so you can tick that box instead?

Shednik · 07/10/2018 14:14

I'm not sure why you wouldn't tick separated!

MrTrebus · 07/10/2018 14:15
Hmm
Saltypeanuts · 07/10/2018 14:16

Yes definitely separated

Surely a category such as 'married but not living with the bstard' could be added!*

There is a category for that. It's 'separated'

CuriousaboutSamphire · 07/10/2018 14:37

He got you properly, didn't he?

Not living with you not supporting his child from, what 12/13 years old and presumably not being accommodating so you could claim any/all benefits... or why would you still be asking that question, 4 years later?

You have been separated for 4 years! You could have been divorced 2 years ago!

BlueBug45 · 07/10/2018 15:13

Next year or when you hit 5 years exactly put in for a divorce - your "husband" cannot contest it.

AamdC · 07/10/2018 15:19

Well yes you are seperatef because you havent divorced him when or if you do than you can tick divorced surely ?

MrsOprah · 08/10/2018 06:40

By gov.uk definition, you are seperated

Thanks, this is very helpful.

It I think I was just confused because there has been no formal/legal procedure to separate.
