A family member owns a flat in London. It's ground floor and the upstairs flat owners hold the freehold. There is a condition that ground floor owners will pay 50% of any associated building repairs to freeholder. The roof needs repairing and instead of just re-roofing the upstairs owner is adding a loft extension and is passing on 50% of this cost to owner of lower flat. Are we BU to think this is CFuckery at its finest?

As I understand it they are only liable for 50% of building repairs not of any improvement works which the loft extension is.

OnlyFoolsnMothers · 22/09/2018 20:56

That can’t be legal! Fool if they pay that! I’d get an independent quote on repairing the roof if I were them

itswinetime · 22/09/2018 20:58

I don't know wether to be impressed or disgusted! Of course they are being beyond cheeky ground floor flat is liable for 50% of the cost of making the roof fit for purpose again not an extension! Reject the quote and tell the upstairs flat you think you should both enage solicitors to go through the contract as there seems to be confusion over the splitting of cost hopefully that will show them you aren't taking any of their shit!

Sleepyandtired21 · 22/09/2018 21:03

Contact a solicitor. They can’t charge for a bloody loft conversion! Ask for a seperate bill detailing roof repairs only and nothing else. That’s outrageous cf-ery!

flumpybear · 22/09/2018 21:04

Could be very lucrative If they sell the upstairs flat they're creating!

Otherwise it's just roof only and if they want an extension then you'll need a solicitor ASAP

CrabbityRabbit · 22/09/2018 21:07

No to improvements over repairs. Read the contract and get a lawyer.

Bluelily87 · 22/09/2018 21:13

There is no way they can charge for the loft extension. They are just trying their luck. Just laugh and ask what the bill is for just the repairs and get an itemised bill

LadyGAgain · 22/09/2018 21:27

Hahahahahaha!! They must have some big balls. I'd howl with laughter and tell them "good one, you got me. Just send me the real quote for the roof and we can talk then".
(Whilst also contacting my solicitor)

Narnia72 · 22/09/2018 21:38

I'd get an independent contractor in to (a) quote and (b) check there was actually work that needed doing...

Holidayz · 22/09/2018 21:41

I believe, from what my mother told me the roof has already been removed! Shock

I'll pass on the advice.
