To think I shouldn't have to pay this Plymouth parking fine?

Earlier in the summer I hired a car to take on the ferry to France. We sailed from Plymouth and 6-7 hours to kill before sailing and went into a multi-storey carpark signposted 'parking for the Mayflower'.

It was utterly rammed - we basically sat in there for the best part of an hour bumper to bumper. We got up to the top - there were no spaces whatsoever. I saw one person in front get parked in that time. Because I could see people at the pay machines I thought they were leaving - ime you pay at machines on leaving in MSs, so I made the mistake of going round again. At one point, we did find a space but it was ridiculously tight and, being in rental car a lot bigger than my own car, I had to give up. There were people right up behind me - it was horrible. At that point we'd been in the carpark about 40 minutes and it was beginning to feel like our whole holiday was going to be spent in there!

We then found a space in the open air in front of the water where you had to pay by phone, which I did and we stayed there for four hours.

Yesterday a fine came through via the rental company for the MS carpark I never actually parked in - they obviously have cameras to catch you going in and out. Now I have no proof that I never parked in there, except. looking at my phone records I have the call and text for the other carpark, and I'm pretty sure it's the same company - both have Bournemouth phone numbers. So why would I go in somewhere for 50 minutes, fail to pay then repark just outside for 4 hours and pay! AIBU to think they will accept that?

Fwiw the first carpark was an utter shithole imo. It should have displayed a 'full' sign - if they can afford the technology to record people going in and out, then surely they could do that as carparks round here do. We wasted nearly an hour in there, and it was hellish. Also it was pay and wanky display! Who does that now? If it had been a 'normal' carpark' with a barrier that dispenses a card this wouldn't have happened as I would have had to get assistance to get out at the time. Also the spaces were ridiculous. I know I could have probably parked had I tried again, but the only other person I saw parking had to be guided in by passengers - I only had small children with me.

I f I have to pay it will be £140 - because I will contest which means I won't get the 'cheap' £50 fine, Angry and the rental company charge £40 admin fee for transferring it to my name which is refunded if I win an appeal. AIBU to think I surely won't end up paying that?

I'd appeal it with your evidence. It sounds ridiculous like you say most multi story car park show full so you don't bother going in what a waste of time . Deffo try and appeal.
My job I pay PCN's so if they reject it you should still be able to pay the reduced amount. Good luck

I’m guessing it’s cheapest if you pay within the first fortnight or similar? IME if you appeal during that time then they acknowledge you contacted them before the full price kicked in, and even if you don’t win the appeal you only pay the £50

If you couldn't park, then they failed to provide the service as advertised and promised. They shouldn't have been letting vehicles in. Absolutely challenge it.

Which car park? I can't work out where you were (local resident) and it sounds like two unrelated car parks to me.

Have you looked on Google Street View for and signage at the entrance about your to pay? If its clear but you missed it, you may be scuppered.

Presumably they'll be having a lot of similar appeals which, even though you won't know about them, will back up your case.

I would appeal. It's not right what they're doing. And you didn't park. Just bear in mind that you should put aside the £180 in the unlikely chance you don't win.

I challenged a parking fine and won on the basis that the parking company didn't respond to the appeal so I won by default.

There have been umpteen complaints in my local paper where people have been "charged" for being unable to park and sucessfully appealed. They have not provided the service that enables you to park your car in a space and leave it.

I hate this assumption that by physically driving into the car park you agree to their terms and conditions when it's not even possible to read them prior to getting in. There's not even much choice to refuse to use car parks with this sort of system as they are becoming so widespread at places like the supermarket.

I've appealed a couple of parking fines in the last couple of years. You should find that the increase in rate is paused while your appeal is assessed. Just outline carefully and clearly what happened with whatever evidence you are able to provide, send it off and wait and see what happens. Should be ok, hope it is.

Thanks all - will certainly appeal and hope to still pay cheap price if it fails - will still be£90 though Angry.

Silverhairedcat it was a carpark next to the aquarium. I'm not claiming not to have seen the signs, of course I knew I had to pay, but I couldn't park. Even if I'd wanted to pay for the privilege of queueing in there for 50 minutes I couldn't have done so without parking the car..

Seems these companies have a license to print money...

My friend who is in the business says it's worth appealing ... but don't get your hopes up.
Also you probably can't contest the car rental fee

That must be an odd set up because every car park round here is either pay and display, where the only way of being caught is by a warden going round as they don't have the numbers
Or numberplate recognition where there would be a barrier at the exit that wouldn't let you out unless you've paid.
I'd have thought a lot of people would be caught by one that was pay on exit, but didn't have something to prove you paid at the end.

Britannia owned car park. Have a look at the MSE forums for other appeals with that company.

Look on the pepipoo parking website and forums. They will give you all the info you need.

I can’t work out which car park it is either.

Don't pay - you didn't park. You have enough evidence that you went elsewhere
