Help - driving licence revoked with immediate effect

LadyRussell · 24/08/2018 11:36

Posting for traffic - help!

DH was diagnosed with sleep apnea a few months ago and informed the DVLA as instructed.

He now has an oxygen mask he wears at night which has improved his sleep dramatically.

He is currently driving his kids home from a trip to the other side of the country and I have received a letter from the DVLA saying his licence has been revoked as of immidiate effect from yesterday - WTAF?

He has NEVER fallen asleep while driving and he lives 150 miles away from us in the week so driving is essential.

He has to prove certain things to get his licence back but this is going to take time.

How the hell can they do this - no warning nothing.

Does anyone know if we can appeal?

Well we are all taking our lives into our hands as about 3.4 million people have not declared medical conditions to dvla according to Direct Line

Thesearepearls · 24/08/2018 22:30

Doesn't sleep apnoea arise only with very overweight people? I'm sorry if I am wrong about this but I thought that was the case. You will tell me if I am wrong

I think there is a pressing case for your DH to revisit his lifestyle. Lose the weight and the rest falls into place.

RainySeptember · 24/08/2018 22:31

Not all forms of this condition preclude driving.

The consultant said he wasn't at all concerned about him driving.

His treatment is working and he is sleeping better than ever.

There wouldn't be many people who'd stop driving in those circumstances, no matter what pp are saying on here.

RainySeptember · 24/08/2018 22:32

OP has already said he isn't at all overweight.

RingtheBells · 24/08/2018 22:35

Thesearepearls. OP said earlier that her DH had a jaw condition which caused it, nothing to do with weight.

incywincybitofa · 24/08/2018 22:36

He might not be a danger or he might, but most likely if he hasn't spoken to his insurance company since he was told to self report he is probably isn't insured but that's ok if there's an accident not connected to his apnea because well he's just not bm insured and was probably told not to drive.

Saidthesharktotheflyingfish · 24/08/2018 22:39

Nothing to do with the debating on the thread really, but there isn't an 'S' in licence (as in driving licence). Wanders back to pedants' corner.

MissCheevious · 24/08/2018 22:40

He needs to do another sleep test so that he has current results for DVLA. If he falls into normal or near normal patterns (which he should do with CPAP) then his license ban can be lifted.

RingtheBells · 24/08/2018 22:42

Woo saidtheshark, I got it right, more by luck than judgement though Grin. I did wonder as I was typing it

Gillian1980 · 24/08/2018 22:42

@Saidthesharktotheflyingfish
Probably autocorrect on peoples phones. My changes it to license

incywincybitofa · 24/08/2018 22:43

Oh and at least its not just his kids he's driving so parents can't make an informed choice you carry on with your fing and blinding because you are of course quite right.
If you really were unsure you'd have probably asked the Dvla and his insurance provider
You know the answer

marants · 24/08/2018 22:45

Saidtheshark In American English, the noun is spelled the same as the verb - license. But in British English, the noun is spelled licence.

Joins you in pedants’ corner...

RainySeptember · 24/08/2018 22:47

"you are of course quite right."

Well they're right that he's ok to drive since his consultant has said that he has no concerns about his driving and he also knows that his treatment is working marvellously.

Obviously the DVLA are missing some information and op has already said that HE WONT DRIVE UNTIL IT IS RESOLVED.

But you know, keep kicking if it makes you feel better.

ARoomSomewhere · 24/08/2018 22:47

I was diagnosed with 'sleep disordered breathing' at an NHS sleep clinic recently.
I was clearly told at the time, that had it been sleep apnoea i would have had to have notified the DVLA and not been allowed to drive home.
Fortunately for me it was 'only' SDB.
The difference is the number of 'events' which occur per hour.
I was 11 per hour. 15 or more is considered apnoea.
You cannot drive until and unless cleared by the DVLA.
They will need medical evidence that the issue is being resolved by the CPAP machine (there is a memory chip which records the improved sleep levels you can use for evidence.

Good Luck with it.

SoupDragon · 24/08/2018 22:47

His consultant wrote in the letter with the diagnosis that he had no concerns about DH driving

Are people missing this? The medical professional treating him stated he had no concerns about driving.

LadyRussell · 24/08/2018 22:48

Fucking hell.

We got a letter this morning revoking his licence which has totally fucked up our world. We have done NOTHING wrong and everything right and most of Mumsnet sticks the boot in.

Well fuck me.

Ok so I won’t mention ops dps weight, as I’ve read the thread I know he’s not overweight and therefore isn’t the route of his problem...

How many people mentioned this?

Op hope you find a solution to your dp not being able to drive

Strawberrybelly · 24/08/2018 22:49

Can he stay where he stays in the week and you go up for weekends until this is sorted?

AnnieAnoniMoose · 24/08/2018 22:50

I think you need this...

Help - driving licence revoked with immediate effect
RingtheBells · 24/08/2018 22:50

OPs DH has declared his condition, we should be worrying about the millions that haven’t and are still driving probably in the car in front or behind you

Strawberrybelly · 24/08/2018 22:51

Just ignore them. If you hadn't opened the letter you would be none the wiser until he got home.

RainySeptember · 24/08/2018 22:52

Don't worry op. I think some people read AIBU in lieu of Take a Break. They seem to love piling on, adding to the drama, repeating spurious facts that have already been addressed, and become furious when disagreed with. And that's if they even rtft.

Nacreous · 24/08/2018 22:53

Maybe getting this shifted into chat or relationships or health would be a good idea OP? The way this thread has gone, I don’t think you will get further useful advice with it in AIBU, and I know something like this would really upset me if I was already highly stressed.

ivykaty44 · 24/08/2018 22:54

As an aside op, you may want to know that your dp is most probably entitled to a free bus pass

Under the heading of “ revoked licence” not through drink or drug driving

Not great but may help
