Hi name changed for this.

Posting here for traffic and the good diversity of readers/posters.

If someone who is a supporter of EDL and britain first and those kind of groups on social media was to be a jury member in a criminal case involving an immigrant (1st gen) would you say article 6 of the human rights: right to a fair trial of the defendant is compromised?

Thanks

No, not yet. Unless the jury is stuffed with them deliberately.

There might be another juror who is like that Dutch student who disrupted the deportation plane.

It is not yet compromised.

Everyone has opinions - you wouldn't have much of a jury pool if you only had impartial jurors, and that's the unfortunate fact of the matter. Jurors are unqualified for the job.

Fortunately the defence and prosecution can reject three each. Whether they ask the right question or reject on a visual basis is anyones guess.

Nc423 · 21/08/2018 20:04

But isnt that the 'job' requirement? To be impartial and only look at the evidence and put any personal feelings aside?

But when someone who has extreme views is part of the jury can they truly let their bias and preconceived notions be put aside?

As above, we live in a democracy and are entitled to opinions.

Defence counsel can ask questions to see if a juror is unsuitable and then object.

Being a juror is not a job, it’s about a fair trial and something about being judged by ones peers. Someone will no doubt know the correct terms. It’s not me.
