God please someone help!

Sorry I am posting here for traffic cos I am extremely worried! My husband has always had 100% perfect credit score. He's had a mortgage, credit cards etc and has never been in debt! Yesterday his credit history was shiny and clear and today, it was on red and it says he's got a CCJ against him at a previous address 2 years ago (we used to live there 6 years ago), same middle name and surname AND same first name BUT the first letter is different (for example, instead of Mollie, it says Pollie). He said he doesn't know what is going on! He is going to ring them tomorrow but I am really worried. Could this be a possible identity fraud or something? He is stressing out, saying his life is over if this turns out to be true but he's got absolutely no knowledge of owing money to anyone! How do we get a full copy of the CCJ? We really need to find out ASAP. Sad

If he gets an Experian report (£2 online) it will show him the details of where/when the CCJ was issued. He should then be able to get a copy from the court or from the creditor.

Perhaps someone at your old address used his undirected post as ID.
But you can sort it out by proving you weren't living there at the time. So try not to panic. Stay calm and just explain the situation calmly.

Something similar happens to a friend of mine - she rented her house out and a tenant racked up £10,000 on a very account then gave notice, left, all of this unbeknown to my friend. It was 3 months later she got a letter
But the fraud squad at the police sorted it.
The woman had emigrated but left her parents address as a forwarding address, fortunately they were horrified and
co-operated with the police
Ex-tennant given 4 year custodial sentence apparently had done it before!!!!

It's possible theres an unnoticed ccj, my sister found she had one when she was suddenly refused credit. It was from a garage for a car service which she'd requested, but her husband paid, bill, their records were screwed up and garage took her to court and found against her in her absence. Never served with any papers so had no idea about it.

Definitely find out which court the CCJ was issued from and get a copy of it. If the name is incorrect as you have said i.e. very similar but slight difference as you described then he needs to speak to someone at the court initially - there must be someway of having it removed if it isn't his actual name on it.

I hope he manages to get it sorted.

This happened to us- commonish name and some junk debt collector company just attached a debt that someone of the same name had racked up to an old address. Lots of research revealed fairly common tactic. The court get so many CCJ applications they don’t check. We obviously never got the correspondence

It was simple to over turn but we did have to pay the court fee and attend, so a total
Hassle. Then it will be removed

Best thing is to call the court and get the details to start. They can advise next steps

Oh dear, this sounds like something that happened to an elderly neighbour of ours some time ago. He moved house and it was renovated by a developer and then new owners moved in. Quite by chance 3 letters were delivered to us in error , so I posted them to his new address ( we kept in touch). They had taken out credit in his name with a letter changed - like Phillip or Philip and all were letters chasing missed payments. Turned out that my ex neighbour had been left on the electoral role when the house was empty and they had used his details.
His didn't get to CCJ ( and there was a whole moonlight flit story with the new neighbours and people knocking on the door asking where they moved to) but could Action Fraud or something help. Money Saving Expert often has useful advice on frauds etc,

Hi everyone thank you so much for your response so far! I checked Trust Online, using my husbands actual proper name and the address that his "apparent" CCJ is at and it is saying nothing is registered! I hope that is correct! I have downloaded the report. He has gone out cos he is really upset so I have been doing some research.

Your husband needs to calm down, his life is not over.

Firstly, I'd post on the moneysavingexpert forums as people over there have a lot of knowledge. forums.moneysavingexpert.com/forumdisplay.php?f=257 ts the correct section.

This could be someone with a similar name and they've somehow attached it to the wrong address.

I'm so glad you seem to be getting matters sorted out - it's very worrying.

Something similar occurred with DS. He moved into a flat and nearly ended up in court. The previous tenant had the same first name and surname (different middle name) and the same birthday (though different year). We have a fairly unusual name, too.

It took some sorting out, I can tell you - and long after he moved out he got chased by debt collectors and was twice served with court papers on this other persons debts.

Obviously the unusual name and birthday complicated matters for him - hopefully you won't have anything as awkward to cope with. It did get sorted, and although he occasionally gets a "try-on" letter from the debt collectors, he doesn't have to do anything except send it back.

I suppose it depends on the name, some are going to be really common - there are two men in my family with the exact same name (different generations and named after family members).

You can prove that you didn't live at that address 2 years ago, you can prove that the name is not and never has been your husbands. It WILL get sorted.

It will get sorted if it's not his. Banks employ tracing agents to trace customers who have moved address when they have debt. You'd be surprised how often the wrong people are traced and their credit reports are damaged.

Quite possibly a private parking ticket. It's very common. You can apply to set aside but must do it quickly. No specific time limit but just don't delay.

Polka - you can't imagine how worrying it is.

It's not just the demanding letters/ threats etc, it's the fear that your accounts may have been hacked or your identity stolen.

Not everyone is as blasé about financial matters as you seem to be.

Because I've lost count if how many I, a single employee working for one bank, have had to fix by going to the credit reference agencies and getting information removed when it's brought to our attention that an error has been made in tracing a customer.

What I was saying, was that if credit references are quite often wrong, then they're not really much use, are they ? Based on your comment : You'd be surprised how often the wrong people are traced and their credit reports are damaged.

But if his name is misspelled it will come up on a search under the misspelled name.

Is the misspelled name still a name eg. Jon and Don because if it isn't and it's something like Jon and Fon it will still come up on address search and companies may assume it is you. If an old debt is pursued at a last known address service by post can be deemed and judgment obtained in his absence. However he can apply to have it set aside. I suggest you do try to get to the bottom of what it is and what it relates to.

Of course it’s worrying, but his reaction is ridiculous. Claiming ‘his life would be over’ and ‘going out’ leaving YOU to try to sort it out? Tell him to grow up. I wouldn’t want to be in a relationship with someone so wet.

You both need to calm down. You weren’t living there two years ago and he’s had a clear credit record since living there, you’ll be able to get it sorted out.

To those who say it is ridiculous that a CCJ means his life is over: what I mean is that it has completely fucked our chances of ever getting a mortgage or even a car on finance which was what we are planning! He is the main earner, I am on minimum wage so as for me putting it all in my name is going to be a big no no! Anyway, he has got in touch with the court and the claim is true unfortunately so now we are finding a solicitor to see what they suggest while, in the mean time, he is going to try and find the money to satisfy the CCJ! How did he find out about this CCJ? Does he check his credit score every day over breakfast?
