doorframe32 · 09/08/2018 14:27

I have baliffs after me after a parking ticket from the council I never received went to them, I think the fee is something big, they have not said the exact fee in letters even though I have emailed but if they came and I refused to pay what exactly can they do in the end if I hid my car??

This link takes you to the citizens advice pages on dealing with Bailiffs if you are in England. If you are elsewhere in the UK you need to visit the main citizens advice site and select which UK country you are in as the law differs.

Winterbella · 09/08/2018 14:32

They'll take other stuff doesn't have to be your car

strongandlong · 09/08/2018 14:33

What does the letter say? It should say exactly what you owe and to whom.

What company is the letter from? Is it actually court appointed bailiffs or a debt collection agency?

Purplecrocsrock · 09/08/2018 14:34

Don't let them in the house- join thr group beat the bailiffs and the banks on facebook they have excellent advice to get the debt back to the original people i.e. the council

SillySallySingsSongs · 09/08/2018 14:34

Well they could go to court if they haven't already for starters.

Really not a good idea to hide your car!

londonrach · 09/08/2018 14:34

They take items and sell them to cover the fineyou owe. Each time they. Visit they add more money onto your bill. Dont ignore this.

Governoress86 · 09/08/2018 14:36

Can you call the council to clarify the issue and the amount owed.
The bailiffs need to give you something in writing stating what is owed and what for and who sent the debt to them along with any fees that they have put on.

I'm not entirely sure what will happen but from what I have been told in the past is they can not break entry to your home with out a high court writ it has to be peaceful entry. Again I'm not entirely sure if this is correct .

With regards to the car, I think if they have already got the reg and checked it's not on finance they can take control of it but again I'm not 100%.
But my partner has said that it is illegal to hide cars/ goods from them if they already know about them .

Dermymc · 09/08/2018 14:36

It takes a long time for bailiffs to get involved. You should have spoken to the council and paid the initial fine. Set up a payment plan if necessary.

You could try the council now and see if they will accept the original amount.

''What company is the letter from? Is it actually court appointed bailiffs or a debt collection agency?''

I am in London, the council was Westminister and they sold it to an Essex company.

SillySallySingsSongs · 09/08/2018 14:38

Is the company working on behalf if the court? That is very important.

I did, I even appealed it as I did not get the letter as I moved address and then registered the new address a few weeks later so they were working off an old address, I told them that but they just said the new company was taking it on.

daisypond · 09/08/2018 14:39

So it's a debt collection agency, not bailiffs? They're not the same .

PinkHeart5914 · 09/08/2018 14:40

Hiding you car won't help. They can take other stuff (I.e TV, sofa etc ) it doesn’t have to be your car. If you say you don’t own the sofa they will want proof with in the way of receipts/card statements to shower who paid.

The letters must say how much you owe and to who

Hiding your car and burying your head in the sand isn’t going to magically make this disappear, you need to deal with it and come to some solution like a grown up.

doorframe32 · 09/08/2018 14:40

''Is the company working on behalf if the court? That is very important.''

I am not sure, the council just said they went through the court and passed the debt on I think.

gamerchick · 09/08/2018 14:43

Can you not just pay it? They should tell you how much you owe if they're a debt collection agency.

doorframe32 · 09/08/2018 14:44

Daisypond I pm you the debt collectors in charge of it

We were in a similar position. DD's abusive ex took out a loan in her name and never paid back. Loan company sold the debt on to a collection agency called Interim Justicta. We got a hold put on the bailiffs by writing to Interim Justica and the loan company (registered post) saying we were in dispute with the loan company. This was because we queried the amount - what was loan and what was interest? They failed to tell us.

SillySallySingsSongs · 09/08/2018 14:45

You really need to find out as it makes a huge difference to what your rights are.

doorframe32 · 09/08/2018 14:49

Thenightsky how was the situation resolved?

OP you need all the correct details for anyone to be able to assist you with answers. At the moment you are unsure if quite alot of important details that really do make a difference in how to handle the situation. Go away & give the company a call & fund out exactly what you owe, who they are & there rights (which should be outlined anyway on your letters).

Lemontart25 · 09/08/2018 14:54

*apologies for typos Blush

Advice79 · 09/08/2018 14:56

Contact TEC (traffic enforcement centre) for advice. If you didn't receive the penalty you can fill out forms PE2 and PE3 I think and appeal. You will have to get them signed by a court/member of court so make an appointment now. Once form is received back at TEC it's processed within 24hrs and an update sent to the council by 4pm to put case on hold. The council should tell the bailiffs to put it on hold whilst they investigate within 24hrs

Neshoma · 09/08/2018 14:58

OP, it sounds like you will have to pay the debt so it's pointless trying to find a way to avoid it.

Pay up now before the debt grows.
