...to claim mileage/expenses after redundancy?

I was made redundant in May and, after a couple of weeks break to recover, have started up as self employed hence spending loads and earning SFA.

I got my P11D a little while back which reminded me I hadn't had my mileage / expenses paid for my last claim and also hadn't put in a claim for a few months after that, up till my last day.

AIBU to expect them to pay me for c8months mileage / expenses if I send them in now?

If you're within the typical limit (3 months where we are) i don't see why not. Are they usually paid separately to salary?

BlueJava · 09/08/2018 00:27

Well you could try but you may have accepted a payment in "full and final settlement".

Winterbella · 09/08/2018 00:30

Well you are certainly entitled to them from your employer but if you have the records and they won’t pay out you can put a claim in with HMRC for the statutory rate after the tax year has ended, so if they were up until April this year you can put that in now and after that put in next April

No full and final, just a stat redundancy payment of 3wks which I bought a cheap replacement car with and lived on then exhausted my meagre savings. They were usually paid seperately to salary, yes.

Being made redundant doesn't mean they get to land you with the expenses involved in their business from when you were employed. Of course, YANBU to ask for what you're owed.

Depends o the wording of the company’s expense policy or rules. Some companies have a cut off point for claims and don’t have to honour them.

If they don’t have a cut off and don’t pay you’d have to make a breach of contract claim. You’re out of time to bring it in an Employment Tribunal which expires 3 months after your termination date. This means you’ll have to issue the claim in the county court which means you will have to pay an issue fee. If you win your claim you’ll get those fees back.

Put them in, what have you got to lose? I think you're owed it and they should pay, but even if they refuse on a technicality you're no worse off for trying.

you can put a claim in with HMRC for the statutory rate after the tax year has ended,

Only thing you can claim from HMRC is tax relief......

CheekyRedhead · 09/08/2018 07:57

Depends on your expenses policy. Ours is 60days. After that its a no unless you have md written approval. Only really done in vases of long term sick. When sickness was unexpected. Deadline is your responsibility

HMRC will pay my mileage? Is that a thing? What is the reasoning?

TitusPullo · 09/08/2018 08:13

No HMRC will not pay your mileage. What they will do is allow you to deduct your legitimate business mileage from your employment income which means the amount of tax deducted at source was too much and you will be refunded the excess tax.

Namechangeforthiscancershit · 09/08/2018 08:44

Ah well that’s much less exciting so I’ll stick to claiming it the regular way!

BubblesDahling · 09/08/2018 12:25

Thanks all, I'll submit them and if they don't pay then go the tax relief route.

Star's all round!
