To think the bank are liable for their pension scheme

My dh passed away 12 months ago. He worked for the Bank for over 30 years and I. Had to fight long and hard to get all the money we were due from.them

It took over 9 months to get it sorted. They told me I am due compensation but just not from them. I need to claim it from the pension administrators

Aibu to think that that dh's contributions were paid off his salary therefore the contract is with them and they should pay compensation that's due and claim it back from the administrators if they feel its their fault

Your employer deducts your tax and passes it to the Inland Revenue - you wouldn't expect your employer to be responsible for rebates would you? Same principle applies to pensions, they deduct at source and pass the money to the administrators. Your complaint is with them, not the employer

It will depend on the sort of pension they set up. All pensions are independent of the employer and they provide it as a workplace benefit but they do not control it. They will have an in with the administrator of the scheme but if they are pointing you that way then you will need to go through that process.

Because of complicated tax rules the employer cannot pay you and claim it back from scheme (whatever type it is). The administrator will only be able to pay it to you- they can't pay the employer. Sorry - pensions law is my job.

Having said that I have seen situations where both employer and administrator point the finger at each other and the member and beneficiary get stuck in the middle. However if you haven't spoken to the administrator about it you need to. They can be very helpful and they should want to be.

Each situation like this is very unique. Talking to the administrator so be the best way forward. Good luck
