KIDS CLAIMS

I saw one of those advertisements for compensation that solicitors do today,(on kids TV!) but this was specifically for claiming compensation for kids accidents outside the home. It said from a cut to more serious injuries ...and included at school!!
I'd be interested to know what other people think about this.

not unheard of. I suspect schools often pay out depending on how much is claimed because of the costs of defending themselves in court. I think they are a bit stuffed since don't the claiments not pay anything unless they win?, also don't know if anyone would get legal aid for this.

I think it's terrible that someone would sue the school because of an accident. My dd fell off the climbing frame and twisted her ankle at school last week, she ended up in casualty having an x-ray, lukily it wasn't broken, but even if it was it wouldn't of crossed my mind to sue anyone. Children have accidents.

its a sad state of affairs and says a lot about society that they are looking for someone to blame even when a child has an accident.

One of my daughters fell over in school, she slipped on some leaves and hurt herself she complained to the teacher who told her not to make a fuss anyway ex h took her to the dr, which incidentally is literally across the road and it was broken. I was really mad as hell with them and I made sure they knew it but it didnt occur to me to sue them as it was an accident and they do happen.

I've seen that ad too. its ridiculous. Soon they won't be allowed to do anything because its too uch of a "risk". kids are supposed to have accidents, its how they learn to look after themselves. I help with a guide unit - none of them will touch a match. how are they supposed to learn how to light one safely? wrapping them in cotton wool does not hep in the long term.

God that is insane, and this is coming from someone who does PI claims for a living

The only way someone can claim is if it can be shown that someone has breached a duty of care and been negligent. As a mum and lawyer I would say that this is highly unlikely to be the case with most kids injuries, kids fall down, knock themselves over, fall out of trees etc all the time, no-one is to blame for that, absolutely bonkers IMHO

DeJager · 01/06/2007 13:09

Insane, you send them to school knowing that things might happen, like at home, you cannot watch them 24/7, so how can you expect a teacher too?
My 6 year old neice was bullied, for a number of months by the same little boy, and it got really bad, but we just sorted that out with the school and it stopped.
Never would have sued anyone, but had it continued, we would have contacted social servies or the police.

Emprexia · 01/06/2007 16:42

Insane, unless the school itself has been negligent and thats whats caused the accident.. like not repairing holes in the playground, or digging up tree's on the field and leaving the hole open for someone to put a foot down, both of which happened at a school by me.

If it was just a common or garden kid accident, then yes, it would be insane to sue.

Pixiefish · 01/06/2007 16:45

At the school where I taught we had a family who used to sue the school for anything.

There were 3 boys and they sued for a trapped finger, one fell off te monkey bars in the gym. They threatened to sue regularly.

The thing is that generally it isn't worth claiming on the insurance for a few thousand pounds so the school generally stumps up the money themselves. Less resources then for the other pupils

wheresthehamster · 01/06/2007 16:53

The knock-on effect is that schools won't provide any sort of playground equipment, trips, PE with apparatus etc. for fear of accidents.

LIZS · 01/06/2007 16:56

Completely mad but in some countries you have insurance as part of your household cover for 3rd party damage , should your child cause an accident.
