To ask you who had right of way

Pedestrian crossing the mouth of a large side road, with traffic island halfway across, had just reached the island although a few yards to the side of it.
Car indicating left to turn from main road into side road, in front of pedestrian.
Pedestrian kept walking, car kept driving and turned in. No one was hit but it was a bit close!

Who was in the wrong?

The car imo

LaMainDeFatima · 23/07/2018 19:45

Pedestrian should have only crossed when Road was fully clear

FreshGarbage · 23/07/2018 19:45

Car is in the wrong.

Bamaluz · 23/07/2018 19:45

The pedestrian already crossing the road had right of way over the car.

DingDongDenny · 23/07/2018 19:46

Definitely the car - the pedestrian has right of way

Sleepyandtired21 · 23/07/2018 19:46

If pedestrian was on the island when the car begin to drive, they should have stayed there. If the pedestrian had begun to cross when the car appeared, the car was in the wrong

Trinity66 · 23/07/2018 19:46

The pedestrian

JacquesHammer · 23/07/2018 19:46

Pedestrian was in the wrong, they should have crossed further down the road away from the island.

Glad it wasn’t more serious!

didyouseetheflaresinthesky · 23/07/2018 19:46

Pedestrian in my view. If you can see a car turning in don't walk into the road.

BreakfastAtSquiffanys · 23/07/2018 19:47

Just checking--pedestrian was crossing from top of picture to bottom and had passed the central refuge?

Trinity66 · 23/07/2018 19:47

The pedestrian had the right of way I mean

CandleWithHair · 23/07/2018 19:48

Yes, pedestrian crossing from top to bottom. Side road is quite wide so they would have started crossing the top half of it before turning car appeared.

Buildabear · 23/07/2018 19:49

If the pedestrian had left the island they had right if way as they were already crossing but if the car had started turning in before they left the island the pedestrian was wrong

ProudThrilledHappy · 23/07/2018 19:49

Was the traffic island a designated stopping point with a dropped curb and a space to stand on, or just a raised section with a bollard?

I think if it was the latter then the pedestrian was in the right as they were already “in the road” and so have right of way.

trevthecat · 23/07/2018 19:49

Pretty sure pedestrians always have right of way. Might not be in best interests or polite but sure they do

John4703 · 23/07/2018 19:49

To quote the Highway Code
Rule 8
At a junction. When crossing the road, look out for traffic turning into the road, especially from behind you. If you have started crossing and traffic wants to turn into the road, you have priority and they should give way (see Rule 170).

SharronNeedles · 23/07/2018 19:51

Doesn't really matter who had right of way, the car has a duty of care to pedestrians since they are not safely protected inside a giant metal box.
Drivers should always, where possible and safe, avoid driving towards any pedestrian.

More or less verbatim from my speed awareness course I took a couple of days ago

Grimbles · 23/07/2018 19:51

Pedestrian has right of way if they are already crossing

ShesABelter · 23/07/2018 19:52

The car should have waited. The pedestrian was already crossing the road so had right of way. Why wouldn't the driver just stop anyway. Seems impatient and dangerous to me.

MsHopey · 23/07/2018 19:55

Pretty sure pedestrian always has right of way, even if they're being morons.
It's the drivers responsibility to not hit them.

inabeautifulplace · 23/07/2018 19:55

Car is in the wrong, pedestrians have right of way in this scenario:

www.highwaycodeuk.co.uk/road-junctions.html

Not many people abide by this though, so pedestrians are likely to wait if they see traffic, to avoid being run over by a twat. The number of people I see railing the blind corner by my daughters school boils my piss.

Butteredparsn1ps · 23/07/2018 19:56

It’s more worrying Imo that the question is being asked!

Car turning into side-road gives way to pedestrians.

SassitudeandSparkle · 23/07/2018 19:57

Pedestrian should have stopped on the island when you could see the car turning in, it was probably indicating anyway so you knew it would be turning. If the pedestrian was crossing from bottom to top then they would have right of way but the island in the middle makes it a bit more complicated, I think.

inabeautifulplace · 23/07/2018 19:58

Drawing is actually wrong as well (though pretty awesome to be fair!) There should be a single dashed white line where the ped is. For me, this indicates that cars should stop when turning in, unless the way forward is clear.

willyloman · 23/07/2018 19:58

The car gives way. Unless driven by psycho.
