I live in a freehold house on a new build estate. Our road has been adopted by the council, however we are expected to pay twice a year for a maintenance company.

They are mainly there for the flats, but for the houses they are meant to cover;

Insurances for pavements and parking spaces
Maintenance to shared borders and pavements

A new company took over before Christmas, when the gardening was somewhat lacking with grass overgrown and weeds taking over the pavements and borders. I emailed including pics. They promised to sort it out, we paid on time.

6 months on, not one single visit from a gardener. The site is looking like a mess. Another bill comes through, I email to query why they've done nothing in 6 months. Apologetic email back, they're getting new gardeners. Week later residents meeting with management company. Never been before, but there are many cross residents expressing their awful service. Apparently they didn't pay the previous gardeners and have the money (a few grand) sitting in an account.

Anyway, until today (at least 3 weeks on) no maintenance what so ever. Today spotted a bare minimum done, HOWEVER they have not mowed the opposite side of the road as apparently thats council territory. I mean it's a tiny space and the weeds are wrecking the pavements.

Same day we get a red reminder. Reminder claims if we don't pay this time we will have a dept collectors after us. They have seriously done next to nothing.

We can pay, but feel resentful giving such a lazy management company anything, especially when we are overlooking the side of the road that's totally ignored. What would you do? I'm wondering if we could claim they breached their contract in not maintaining for soo long?

I looked at reviews for the company online and it's really bad.

Who decided what management company to use?

Cancel their services and find another one and tell them to sing for their money.

I'm not sure tbh. It's a big site and we were told when we bought that we would have to pay a maintenance company (literally as we were about to sign final contract). Anybody who may have been in a similar position know where to start?

Write to them and ask them for a summary of the accounts and to see receipts- they legally have to disclose them. If they aren’t paying contractors to do the agreed works and just holding on to your money they can’t just keep demanding more- unfortunately doing nothing probably not ideal.

Is it RMG? They’re a nightmare! There’s a Facebook group with advice how to oust them on it if so

Not sure if I should out the name. But interesting to hear others with a similar problem. It feels like the builders sell some sort of lease to a big London company and screw all the purchasers over. One friend moved into a new build and was informed after they were contracted to pay for the new park (family area, so I'm amazed they weren't expected to do this as part of the planning concent). Apparently each resident is expected to pay for the next 20 years. It feels a bit criminal.

Good idea to request a summery of accounts. Thanks for that tip.

Yes the yearly accounts/sink fund etc

Request a visit from them so they can have a look at your concerns

However, don't hold your breath

I'm curious if anyone knows how this happens? Who sells the lease to a freehold estate? Who profits from It?

If the road has been adopted by the council then surely maintenance and weeding etc should be undertaken by them. That's what council tax is for.

Someone has to pay for shared space maintenence - if the council has not adopted parts of it, it is fair for the residents to pay.
It is an issue, see www.theguardian.com/money/2017/dec/02/homeowner-freehold-management-fees-unadopted

What a shocking article! It's truely criminal and I wonder if there are people taking back handers over selling these leases off to crooks?!

Can you not get a residents group together and sort these areas out yourselves and refuse to pay?

If you refuse to pay, current law allows the service providers to approach the mortgage company who will pay to avoid repossession and then add to your mortgage, probably with costs and threats to foreclose.
The law is rubbish in this area.
