AIBU to think this response form the government about hit and run drivers has missed the point?

There was a petition about hit and run drivers;

Increase the sentence for failure to stop after a fatal road traffic collision
My brother, Andy Lindup, was killed in a hit and run in Dec 2016. By the time the driver was arrested, it was too late to breathalyse him and gather evidence for a charge of dangerous driving for which he could have faced up to 14 years in prison. Instead he got just 6 months for failure to stop.

The Government has responded to this petition;

''The offence of failing to stop should not be used to punish an offender for a serious, but not proven, offence. Other offences can be used if there is evidence of other criminal behaviour.''

I don't think the response answers the point of the petition.

There response says what they wanted to tell you about the subject as opposed to the answers you wanted to hear. It's entirely accurate, not much comfort no sign of a change in the status quo.

I haven't seen any of these petitions come back with any meaningful response

Not sure what I'm missing tbh, the response sounds sensible. Confused

"Where there is evidence that the driver caused harm there are a range of other offences available and the failure to stop will be treated as a further and aggravating factor in the sentencing decision. Where the driver takes action to avoid detection this may amount to perverting the course of justice, an offence which carries a life sentence maximum."

''Where there is evidence'' is the problem; people leave the scene to destroy the evidence.
