Compensation - Holiday related

I’m interested to know peoples thoughts on this. If you went on holiday, and building works started when you arrived, without the travel company you booked through having any knowledge, do you think you would be unreasonable to complain and expect compensation from the company you booked through?

Were the building works in the hotel or surrounding? Planned or emergency maintenance? The tour operator is responsible as your contract is with them but it would be hard to prove that it was pre planned and they knew.

WhenISnappedAndFarted · 03/07/2018 19:13

It depends on how much the building works impacted the holiday.

That's happened to me before, didn't impact my holiday so didn't complain or ask for compensation.

If you went on holiday to sit by a pool and relax but the building works meant that you didn't have access then for me that's a different matter. In that situation I would complain.

Depends on how it impacted on your holiday.

Pinklady1982 · 03/07/2018 19:14

The building works were pre planned apparently, but the holiday company didn’t know as it was the council who didn’t inform them. They were opposite the accommodation and was noisy everyday.

If the travel company had no prior knowledge of building works how can they be responsible. Did this happen to you, did you complain to the manager at the time.

LIZS · 03/07/2018 19:17

So well beyond the to control? Unless the to owns/leases the hotel (ie. TUI) I doubt they can be held liable. Did you complain at the time or ask to move?

Mari50 · 03/07/2018 19:17

Complain and get compensation from ?

HeGotManFlu · 03/07/2018 19:18

Was this in the uk, how did you book the holiday, some booking sites will say if there are roadworks or building works going on.

WhenISnappedAndFarted · 03/07/2018 19:18

Surely it's not their fault if it's across the road? It's not good but not the end of the world. I'd maybe complain but not go further than that.

ChipsAndKetchup · 03/07/2018 19:19

Was it TUI? They are royal fuckwits

Pinklady1982 · 03/07/2018 19:39

I actually work for a tour operator ( a different one), so I know how these things work in general, but this is about my friend who is adamant she is entitled to compensation from the travel company, and we have had a bit of a falling out about it. I have heard her on the phone really laying into them, and threatening to slam them all over social media etc. I just think it’s wrong, and nobody deserves to be spoken to that way. I might be a bit on the defensive side as I have been on the receiving end of such phone calls, but I just wanted to hear other people’s views and try and talk some sense into her. In my company (no it’s not tui) we always sympathise (we all look forward to holidays at the end of the day) but get treated like we are robots in these situations. Sorry I didn’t fully disclose initially, but thank you for your views on this, it’s nice to know not everyone is just after compensation!

OP I don't think she is entitled to compensation at all, she can complain but ranting and shouting at people and threatening them over social media is out of order.

I know noise isn't great but she should have complained at the time and they might have been able to move her somewhere.

Pinklady1982 · 03/07/2018 19:43

Exactly, we will always try to move people if there is availability to do so. But unless we know at the time, we can’t help!

I think it depends. If i had rented a sea view villa on a resort described as peaceful and the building works disrupted the view or the peace more than 1/7 of my holiday, I would expect some compensation because I hadn’t been able to enjoy what I had paid for.

If I was in a large all inclusive family hotel with entertainment and shows at night, and the noise was due to another big hotel being built next door and lasted all week I would think it was just bad luck.

I would expect hotels to do their own refurbishment outside of peak season to not disadvantage guests, and think that this could be grounds for some form of compensation.

EnglishGirlApproximately · 03/07/2018 20:48

I agree OP if the tour operator genuinely had no idea they can’t be held accountable really. Threatening them really won’t get her anywhere! If it’s Tui they really don’t care about social media reviews, they’re big enough for it not to impact them at all!

NapQueen · 03/07/2018 20:51

Did she speak to her rep/hotel manager while she was there?
