I just started a thread but the title wasn’t very clear.

Basically is calling someone a white bitch classed as racism. Would you be charged for the same crime if you called someone a black bitch?

Sorry very controversies and not very appropriate, but I have to ask the question.

"The Act says a "racial group" means a "group of persons defined by reference to race, colour, nationality (including citizenship) or ethnic or national origins."

Some people take the view that racism is only racism if there is both discrimination and power. But this is not how the law treats it and I don't favour that approach (personally I think discrimination without significant power is ineffective racism, but still racism).

Idk about the UK but it would be in Germany and Switzerland.

The law generally doesn't let its definition of racism be influenced by the idenity of the accused / whether the accused or the alleged victim are from a disenfranchised or historically opressed groups. (as far as I know, not my area of expertise).

It may very well matter in practice but when we're talking about the law (on paper)? These kinds of laws (also in areas of employment discrimination etc) happen to protect everyone in regards to their race and ethnicity (in theory).

(My comment is probably a mess. But I had to take allergy meds and I'm in this weird state of sleepy but also very awake...)

Yes, due to the word white being used. Any reference to colour is key.
