To change my resignation date?

I'm currently working part-time and over the past few weeks, it has become increasingly difficult for me to travel to work. Not only that, my coworkers have become involved in my personal life and I don't like it. I'm medically unfit to continue working.

I've told my employer last Monday that I was willing to work up until the end of July, but my employment contract allows 4 weeks notice, so I can leave first week of July.

The problem is, my workplace is extremely stressful. We are understaffed, being paid minimum wage, with no employee benefits. We are monitored 24/7. Despite completing all my assigned tasks, weeks later my employer will message me saying "Did you complete such and such? How come I cannot find it?" It feels like the entire office would be lost without me.

My employer has said "I don't see why you're resigning when you only work 3 days a week. We've also been running this place without you for a while." I personally found this extremely rude.

I've messaged him saying I intend to leave sooner. He responded saying we will discuss tomorrow. He just doesn't get it. I'm not happy working there. I don't want to just not show up to work one day.

I'm high risk pregnancy, he knows this and doesn't seem to care. I've worked 2 years for him and he does not intend to pay maternity leave.

AIBU to leave?

Just leave when you are entitled to.

I don't see why you would expect him to pay maternity pay if you're leaving though? If you're staying, he has to by law - it's not a choice.

Madonnasmum · 17/06/2018 19:41

You can only be asked to work your contractual notice, so 4 weeks it is. He can't make you work longer.

iamf · 17/06/2018 19:41

Jasmina, I don't expect him to pay me after I leave. He has openly told me as a small business, he won't be doing so even if I do stay. This is why I don't see the point in staying.

If you are medically unfit to work why are you still working? Surely you can get a sick line from your gp? Work sounds rubbish and it sounds like it is making you feel even worse.

Sorry you are in such an awful situation but I think you need to put you and your baby before work. Hopefully someone will be along with better advice. Take care

iamf · 17/06/2018 19:44

Madonna, yes, exactly. He will try convincing me to stay on tomorrow and I don't want to. What can I say to make it black and white that I am completely done working there.

Sunny, I'll be in hospital in the next few weeks. I will ask for a sick note from them. Knowing my employer, he will ask if I can work from home. You know, he's had 6 people resign from the office. No one has ever been happy working for him.

So you have handed in your notice? Then get a sick note to tide you over until that date so you dont have to go back at all. Thats what my aunt has just done. Think of your health. This company doesnt give a shit about you or your health so you have to. They will either run themselves to the ground or find someone else to do the donkey work.

BellaJessica · 17/06/2018 19:48

Honestly op theres not a single time next year and there after you will look back t this and think I wish I had stayed longer."

Gazelda · 17/06/2018 19:49

I think you need to behave formally from now,on.
Give him written confirmation of your resignation date and the date your 4 weeks notice will expire (ie your last week of employment).
If your medically unfit to work, get to the GP first thing Monday to get a sick note confirming this. Take a copy before forwarding it to your employer, advising you will be unavailable for work until the sick. One expires.
Make sure you've calculated (and agreed) all of your annual leave allowance. This can be taken before your end of employment, making your last day in the office earlier.
Take care of yourself and baby.

I wasn't clear from your post if you were talking about not being paid contractual maternity pay or SMP. If you are entitled to SMP and hand your notice in after a certain point, you must be paid SMP anyway.

I woukd get signed off sick if you're not fit to work, it's not worth the stress. Take care x

busybarbara · 17/06/2018 19:59

He has openly told me as a small business, he won't be doing so even if I do stay

Weird, small businesses get the full amount paid to them plus a little extra so it costs nothing to them except for admin anyway. You should have stayed on, got all the maternity pay then quit at the last minute like I did.

Di11y · 18/06/2018 09:59

Are you medically unfit due to the pregnancy? You can be off sick then start your mat leave early, and if you've been there long enough they'd have to pay whether they want to or not.

Singlenotsingle · 18/06/2018 10:01

Go on sick leave and don't bother going back
