in requesting that my non paying strike on my ebay account to be removed?

i won the auction for some tickets for a wwe wrestling event which isn't until october. They were £140. This was about 6 weeks ago.

the listing said he would send the tickets out as soon as he recieves them.

I won the auction and before i paid i asked when to expect the tickets.

He said he wouldn't recieve them until up to 6 days before the event!!

i refused to pay for them as it was a misleading listing and he might not even get the tickets in time to send them out to me before the event. Or he might 'forget' about me and then it will be too late to report it through ebay.

i have now been given a non payment strike from ebay. I have just emailed them to appeal as i think this is unfair.

am i being unreasonable? cos i dont think i am. £140 is a lot of money to loose

I dont think thats unreasonable at all. We had a similar situation. My dh won a phone software thingy (no idea ) and after he looked into it more, it wasnt quite what the seller said. It was a free software that anyone could get, providing they know where to look (my dh is computer geek!) He emailed seller explaining this and that he wasnt going to pay. he couldnt come back with a proper answer. He was new to ebay and his feedback was nothing compared to ours so dh ended up emailing him saying that he can put a srike against us if he wants but we will do the same back for selling a misleading item and report him too. We got an email back saying that he no longer wishes to do business with us! We didnt get a strike! Funny that!

you are not being unreasonable at all but I dont think ebay will remove the strike

You might get somewhere, as I think there's a rule somewherer that the seller has to have the tickets in hand, or available within a short time - can't remmebr exactly, will see if I can find it. Certainly shorter than 5 months!

Sorry, can't find anything. I remember it from when I was looking for Robbie Williams tickets a year ago. Maybe I'm wrong, or maybe they've changed the rules. Might be worth enquiring though.

fruittea could be right I remember reading something a while back saying you had to have the goods you were trying to sell so its definately worth trying

I bought U2 tickets a few years ago and paid for them before I got them because the seller showed me proof that the tickets were going to be sent to him. I dont think you are being unreasonable though just careful.

Items must be despatched within 30 days and must clearly state that the listing is for an item which isn't available yet.

great! thanks Daisy i have just contacted ebay again and also cut and pasted the rules to the seller and asked him to remove the strike.

hopefully something will get sorted out now
