Bailiffs help please

Posting for traffic.

Can bailiffs take work tools and van that they have clamped outside the property? Van worth nothing, tools are "chippy" tools he needs for work. Citizens advice website says they can't take anything work tools wise under the value of £1500 but bailiff saying that is incorrect information on their website.

He also has mental health which they don't believe and are saying they will sit outside until he prove it. He can prove it but on via his gp which obviously can't be done in an hour.

Please advice would be great.

Marsbars yes!! I've seen a few shocking things on there which are not correct - it's a TV programme for entertainment it's not always factually correct! It's also worrying how bailiffs want payment no matter what, sometimes using more debt like from friends and family or a credit card to pay off their debt - it only moves the debt it doesn't solve the problem for the debtor. Stepchange (or any debt charity) would never recommend this method
Username be careful letting bailiffs in - I think they can return another two times (I think) to collect goods and without being invited in, it may not be the last time you see them

MarsBarsAreShrinking · 29/05/2018 17:17

He can't pay if he hasn't got any fucking money. What do some of you want him to do, magic it out of thin air?

namechange3567756 · 29/05/2018 17:18

Well dp has just said he went out to his van and they hadn't really clamped it but put a sticker on it. He's going to text me what the sticker says. Bailiffs have disappeared

MarsBarsAreShrinking · 29/05/2018 17:20

See what I mean? They're mostly full of shit and tell nothing but lies.

MarsBarsAreShrinking · 29/05/2018 17:22

They will almost certainly be back so he does need to get a plan in place. With the risk of sounding like a broken record 😉 the FB group will be able to help and advise.

siwel123 · 29/05/2018 17:24

OP, you realise they will be back and he ahs done himself no favours?

Plasticgiraffe · 29/05/2018 17:25

Marsbars have you seen Beat the Bailiffs and the Banks on Facebook? They also seem to know their stuff

MarsBarsAreShrinking · 29/05/2018 17:26

Yep I've heard of it but I don't know it personally.

namechange3567756 · 29/05/2018 17:28

He's going to phone them.

OP posts:
siwel123 · 29/05/2018 17:28

they're high court enforcement agents.

namechange3567756 · 29/05/2018 17:28

I can't believe they told him they had clamped his van. Confused

OP posts:
namechange3567756 · 29/05/2018 17:30

Well yes of course I realise they are going to be back. They are hardly going to say "oh ok you have no money bye then." Confused

HeadsDownThumbsUpEveryone · 29/05/2018 17:31

I can't believe they told him they had clamped his van.

They probably had clamped it when you posted this morning but after 6 hours of waiting they probably removed the clamp before leaving.

siwel123 · 29/05/2018 17:32

So why didn't he let them in and speak to them? Because all you're going to do is the same thing next time but they will just be less cooperative now.

namechange3567756 · 29/05/2018 17:32

Or realised the scrap man is the only person worth taking that van away!

OP posts:
namechange3567756 · 29/05/2018 17:34

They haven't been cooperative now! They can go in to his flat and clear it for all dp cares now he said. He's phoning them to ask where they are.

DownstairsMixUp · 29/05/2018 17:34

Heads up mostly yours actually. None of the mental health advice here bar one or two posts has been good, if mental health was as clear cut as you all make it seem, there wouldn't be such a crisis within mental health problems in this country!

siwel123 · 29/05/2018 17:35

Your husband or partner refused them entry. Of course they're jot going to play nicely with someone who owns 6k and is being obstructive Confused

lhastingsmua · 29/05/2018 17:38

Well the bailiffs aren’t stupid, I’m sure they assume that you’d have cleared out anything possibly of value in the flat by now

namechange3567756 · 29/05/2018 17:38

Down the understanding and tolerance of mental health is fucking shocking! The ignorance of that bailiff I spoke to was shocking! He thought my dp should have memory loss or no recollection of anything and shouldn't be able to retain any information ShockConfused It's fucking scary how ignorant he was. He admitted to me he didn't a lot about mental health. No shit Sherlock. I think he had a vision that someone should be rocking in a corner head down or something if they have mental health issues Hmm

charlestonchaplin · 29/05/2018 17:41

MarsBars Can you point me to a reliable source that says that they can only take goods if that will cover the full value of the debt? That doesn't seem right.

namechange3567756 · 29/05/2018 17:41

Siwel the general advice everywhere is don't let bailiffs in your property. Especially if you have children there at the time. When they arrived my dp was alone with his dd. He wouldn't have left her in the other room to talk to bailiffs in his property.

OP posts:
siwel123 · 29/05/2018 17:43

Yeah it's the advice and it's stupid at that.
They say don't let them in as they can take goods once inside.
But refusing them entry just pissed them off and quite frankly makes your situation worse.

PetulantPolecat · 29/05/2018 17:44

That’s not that shocking if he was speaking in terms of the kind of issues that would actually make a difference in terms of the debt he owes and his financial liability. Like issues retaining information or memory. Because mental health issues alone - and it has been said a hundred times in these 11 pages - will not give him any special consideration at this point. You keep banging on about their ignorance but it’s yours everyone keeps pointing out on this issue.

sweeneytoddsrazor · 29/05/2018 17:44

How long has he owed this debt?
