To think there’s some action we can take in this situation?

DP is self employed. Every year he uses an accountant to process his tax return. She charges around £100 to do this. She was quick enough to take his money but is now ignoring his messages and his he hasn’t recieved his money. He has now found someone else to process this for him but he still needs his money back from the previous accountant. Since she’s ignoring him, and she clearly isn’t processing his tax return - is there any action we can take to get this money back? She’s done this to everyone he works with too.

What is it you want back? I'm confused about that.

She said she’d put in his tax return but hasnt! He messaged her start of april. Basically - he wants his admin fee that she charges back, as she clearly hasnt processed his return and its may now. He’s happy to go elsewhere, just wants the admin money back. Hope that makes sense!

Letter before action and then small claims; if you've exhausted all other avenues.

Are you talking about the 2017/18 tax return or the 2016/17, which would be late?

I think thats our next step. He doesnt meet her face to face - he just has her number so he’s messaged her a few times saying if she doesnt reply / send him his money back he’ll be taking action. Just wasn’t sure where we would go to pursue it. Thank you - might find her adress on companies house and send a formal letter.

Tax year from last april to this april! So 2017/18 im guessing? He applies for it every April to get his return from the previous 12 months.

Hmm, so he got his info to her first week in April?

Has he not had his return for approval yet? He should be approving it for submission prior to her getting it in. If not it does indeed sound like she hasnt processed it.

Is she a member of any institute?

I'm assuming he's a subbie so due a rebate? They're always the first ones who get their stuff in!

Yeah he’s a subbie. He calculates his income and expenses from the previous years and forwards all that info to her to sort it out for him - hence why he pays her an admin charge to do it. He was out of work for a few weeks last month too and we’ve just moved house, so we could have really done with the money ASAP.

Sounds poor service. If she is in an institute you could make a complaint to them.

Are you sure the return definitely hasn't been submitted already and it's not hmrc holding up issuing the repayment? They can take weeks for no apparent reason.

Have you checked his online self assessment account to make sure it's definitely not been submitted?

My OH is self employed and I do his returns. I did his return end of Jan for year 2016/17 and he is still waiting for his rebate. It's been approved just HMRC are being twats.

And we can't take it to small claims because apparently the Crown can't sue itself!

No many people he knows uses her. She’s gave various different excuses to people (death in family, family members ill, shes ill, car broken down (??)) also just google searched her and she’s been posted on some ‘name and shame’ groups on facebook so it’s not looking good.
