Landlord wants to do major work to the house

I’m moving out of my rental early autumn as have bought somewhere. My landlord has been In contact to say he is putting the house on the market but will need access to do lots of work to it before I move out (installing double glazing in most of the rooms, painting the house, changing the whole boiler system, putting new carpets down etc). This is going to be incredibly inconvenient as I run my business from home and I also have a cat who would need to be put into a chattery whilst all this is going on.
I would have to move to my mum and dad’s for a couple of weeks while he gets people in to do it all. They will be having to move all my furniture and the whole situation is making me feel stressed just thinking about it.
I’m guessing I cant really ask him to wait until I’ve moved out and will just have to let him get on with what he needs to do? Thanks

As your tenancy started before Oct 1 2015 the only thing that will invalidate the section 21 is not protecting your deposit.

Gas safety certs, EPCs and How to rent will only invalidate a s21 if your tenancy started after that date but as you mentioned that you have never renewed it then it hasn't. You will now be on a periodic rolling tenancy.

As PP's have pointed out the S21 eviction process can take 6-7 months as you do not have to leave on the expiry of the notice.

As you are no longer in a fixed term tenancy then the landlord can serve s21 at any time and give you 2 months notice.

He would then have to apply to court for the possession order and you would be able to submit your defence that he didn't protect your deposit. He would then have to return your deposit before issuing a new s21 (and therefore resetting the clock).
He still cannot apply to court for a possession order until the date on the new s21 has expired.

Once the possession order is granted - you still don't have to leave by the date on that order.

He would then have to apply to court for a bailiffs warrant. You are legally entitled to stay in the property until the bailiffs turn up.(not saying that you want to do that btw)

When you want to leave make sure you end your tenancy correctly otherwise you will be liable for rent until this happens.
ou must give the correct date for when your notice period ends. Your notice letter won't be valid otherwise.

Your tenancy agreement should set out the amount of notice you must give.
If your tenancy agreement doesn't set out a notice period, you must give your landlord at least 1 month's notice for a monthly tenancy and must end on the first day or last day of your tenancy period.

Regarding the works the LL is doing- you do not have to consent to let him in to do them.

btw all that changes from 1st oct this year. those rules will apply to all tenancies in england.

This guy is totally cheeky, and taking you for a ride. Can't get the work done with a sitting tenant? Too bad, so sad. He'll manage after you've gone, in your own good time.

And no, it is not 'his home'. There's no way someone this selfish would live in an electrical hazard, but think it was just fine for a tenant.

What a shit, shit landlord.

Of course you can. Either say sorry but no or ask for massive decrease in rent, massive!

As for him not doing any of the work before, it really depends whether the rent you've paid reflects the condition before or after.

It is not your problem, he'll have to wait. If he didn't let you suffer living in shit you'd be kinder I'd be livid too.
Report him if he messed with your security deposit.

You are paying rent and are entitled to "quiet enjoyment" of your home.
The landlord needs to wait until you move out to do works. The fact that he doesn't want the flat sitting empty is not your problem.
