Child maintenance question

Brandnewshit · 24/04/2018 21:20

I have just had a disagreement with someone and can't call cms to clarify.
My ex has moved in with a woman who has a 15 and a 17 yr old.
This wont affect my payments through cms for 13 yr old and 9 yr old will it?

Yes it could if he puts them on his claim, He will pay less for your children as they take into account dependants in the non resident parents household.

Brandnewshit · 24/04/2018 21:23

Wtf there not his fucking kids

OP posts:
Trialsmum · 24/04/2018 21:24

Yes it can if he tells the CMS about them.

BossyPaws · 24/04/2018 21:25

Yes it will as her kids will be classed as HIS dependants. It's fucking stupid.

mintbiscuit · 24/04/2018 21:26

Yes it does. He has taken on responsibility for them.

Brandnewshit · 24/04/2018 21:26

That is the stupidest fucking thing ive heard in my life

OP posts:
Brandnewshit · 24/04/2018 21:27

Even the 17 yr old?

OP posts:
Oswin · 24/04/2018 21:28

Yeah if she class child benefit for them it will affect the maitenance. Hopefully not much. Its a ridiculous rule.

bonfireheart · 24/04/2018 21:29

Child maintenance is a disgrace and there's so many loopholes for the non resident parent and no repercussions.

movinonup · 24/04/2018 21:32

Yes it will unfortunately, Until they (the other children) are no longer in full-time education.
Mad isn't it? As one would reasonably assume that their own Father would pay maintenance for them.

Brandnewshit · 24/04/2018 21:33

Im furiuous. What the actual fuck.

So if my partner moves in, and his daughter lives here she would be a depenedant of mine in the cms stupid rules.
His outgoings have halfed as he is sharing rent and bills, but his own kids could lose out.
I'm actually really fucking shocked

OP posts:
Prettylovely · 24/04/2018 21:35

Yes child maintenance is a joke, I look forward to my yearly letter of letting me know that my children will receive nothing in child maintenance as he is nil assessed as he gets his wife to work while he stays at home "looking after her kids and the ones they have had together" another ridiculous loophole.
Lucky my kids dont need the money from the waste of space.

Brandnewshit · 24/04/2018 21:40

I should be grateful i do get something from him.
Im really really shocked that him shaking up with someone he has known 3 months will reduce what he pays for his own kids, while she will claim for hers from their dad.
This is insane

OP posts:
teenagerparent · 24/04/2018 21:41

It is ridiculous, but it depends on whether he actually tells them there are kids living with him. If you keep quiet he may not realise he can get it reduced.
To give you some context, if he say earns £500 a week then he should pay you for 2 children £80 a week. With 2 children living with him this would reduce to £69 a week.
They count until the parent can no longer claim child benefit for them, so it depends what the oldest one is doing and what the younger one plans to do post 16 education.

Brandnewshit · 24/04/2018 21:44

Right, so it won't be a huge reduction? He pays 350 a month for 2 kids. This was calculated by cms.

OP posts:
Brandnewshit · 24/04/2018 21:46

He begrudges a penny more for haircuts and clothing. He does not buy anything.
I dont work because of MS and my PIP assessment is coming up and this is the last thing i need.

OP posts:
Brandnewshit · 24/04/2018 21:47

And CMS was enforced on him.
We dont do the collect and pay with the reductions but we are close to it

OP posts:
teenagerparent · 24/04/2018 21:50

Google the CMS calculator and put your figures in, it will give you an idea. Hopefully no one will tell him he can reduce it this way! The CMS won't tell him unless he asks them.

Greenyogagirl · 24/04/2018 21:51

I love my monthly update of ‘not paid - £9472 in arrears’
I like to think of it as a high risk savings account that may or may not pay out

OreoMini · 24/04/2018 21:54

Put the figures in online for what you get now and then redo it with the 2 children living in his house... your probably lose £50 a month ish

NeedsAsockamnesty · 24/04/2018 21:55

My ex got a discount for his lodgers kids.
That surprised me

bonfireheart · 25/04/2018 22:38

I also love how regularly I get the letters telling me how much the arrears I'm owed are. It's like a mythical unicorn that I'll never see.

MyKingdomForBrie · 25/04/2018 22:42

A discount for his lodgers kids?!? What??? He must have been lying to CMS then surely??

donajimena · 25/04/2018 22:45

I had one with 11k on once. Disneyland here I come oh no I didn't

NeedsAsockamnesty · 26/04/2018 11:16

He just described them as kids in his household
