Courier delivering to neighbour

I ordered something which the courier delivered to a neighbour last week. I was in the house the day it was 'delivered', they either didn't press the doorbell hard enough or perhaps just chapped (which I can't hear at the back of the house).

Anyway I saw the card and chapped neighbours door, no answer. Tried another couple of times over the next few days and still no answer. Someone tells me they're on holiday (no idea when they'll return).

I've emailed the website I ordered from and stated that I did not give permission for my order to be sent to a neighbour and now can't get my package, can they tell me what they'll do to remedy it. They said as it's been delivered they can't send a replacement and will need to order again and once I get my package from the neighbour send it back for refund. If I'm not happy with the delivery I've to phone the couriers.

I said my contract with them was to deliver to my home address, I won't be ordering again on the off chance I get my package and can get a refund (haven't confirmed neighbours even have the package and don't know them, they might want to keep said package for all I know) I again asked what they'll do to rectify the situation. Also said I won't be phoning courier as my contract is with them, not courier.

Before I keep going and make a fool of myself, I am in the right aren't I? They're in breach of contract here?

The courier can't issue me a replacement though. With situations like this in the past, phoning couriers has only resulted in them telling me to call the retailer. The courier won't be able to resolve this for me anyway as I want a replacement sent ASAP.

Did you pay for it by credit card? If so you may be able to claim the cost back through them.

You're in the right. The courier company won't do anything. It's for the seller to sort out.

The websites own Ts&Cs even state that the contract is between them and me and that items will be delivered to the address specified Hmm

The customer services person was talking about the couriers ts&cs of delivering to a neighbour but I don't have a purchase contract with the courier so as far as I'm concerned that's at their risk not mine.

Have you looked in the neighbour's garden in case they just put it in there?

@mrsjoyfulprizeforraffiawork no, I'm not comfortable opening their gate and looking through their garden. It would be a bizarre thing to do tbh. I also think it's weird that they would accept a package before going on holiday, between that and me actually being at home that day makes me suspect the courier might not have delivered.
It's an expensive pair of sunglasses for my DH birthday too Sad

I meant it would be bizarre of them to put it in their garden without putting a note through my door or whatever

If it's a debit card transaction call your bank and ask them to put through a charge back, on the grounds you haven't received the goods. You may need to escalate to a supervisor and be very firm with them but they will do it. We had to after we paid ££££ for a 3D film that turned out to be only 2D and the cinema refused to refund the difference.

I had a new phone delivered to the wrong address, put in a neighbours parcel area. I had a del time and when I checked the tracking service it had been signed for. Anyway phoned the mobile company and told them that I would be cancelling contract. The courier had signed for it and left it without checking address. I got the phone same day in the evening from a very grumpy delivery driver. Not half as grumpy as he was when he left after I started questioning him.

Neighbour did not arrive home till 10pm as had been on late shift.

Your contract is with the store you purchased from. Regardless where the courier is telling you the parcel is, it's not with you and you need to get that across to them.
You have not received your parcel. It's that simple. If they get totally arsey and you paid by credit card phone them and try and initiate a charge back.
