Posted in employment issues as well but wanted some traffic and quick answers so apologies

Just a quick question - I have handed in my notice and for my job professional subscriptions have been paid in my behalf. Previous leavers have been made to repay this and its made quite a dent in salary.

Earlier in the year I did a lot of extra work and didn't get offered payment or time in lieu.

if mentioned to repay these - am I wrong to say fine but you didn't pay me for the extra days worked. For reference, my contract states 4 days a week and for one month I worked 10 extra days and the payment due would balance out the repayment of subscriptions.

It would make a huge dent in my pocket

I don't want to leave on bad terms but I don't want to be taken advantage of (any more than I already have been!)

Aibu to stand my ground and say no I am not repaying due to extra work undertaken earlier in year?

Generally deductions of this kind need to be set out in your contract or an agreement you've signed. If such an agreement exists that's all - the stuff about being unpaid for other work isn't relevant, and they will take the money from your last payment.

If there's no agreement, then tell them where to stick it. Don't worry about leaving on bad terms, but do stay businesslike and not emotional.

SilverySurfer · 17/04/2018 14:07

I agree with frankchickens The time to have ask for payment for additional work would have been at the time you did the work. If it's not in your contract I can't imagine any company paying you extra retroactively, especially as you are leaving and it has nothing to do with whether or not you will be required to repay the professional fees which IS likely to be in your contract.

I don't think you can try and claim payment for work you did several months ago - you should have brought it up at the time.

If the terms of your contract state that any subscriptions etc. are to be taken from your final salary then I think you may have to suck it up as one of those things.

Thanks

I'm not looking paid retrospectively for the work done
I'm just looking for it to be taken into consideration in relation to this issue

I will hunt out my contract and see what it says

It isn't related though - you need to treat the two things as they are - separate issues.

ChablisLover · 17/04/2018 16:14

Frank - I know they are not related

My question should have been aibu to ask that the time in lieu be taken into consideration?

I am going to hunt out my contract at home but from memory I don't remember seeing anything covered in relation to repayment of subscriptions. And if so, problem solved.

Yes because it's irrelevant.

In your contract you need to be looking for anything that talks about them being authorised to make deductions from wages especially final payments. As you say, if there's nothing, any attempt to reclaim it from your final payment would be naughty.

Mia1415 · 17/04/2018 16:22

As others have said you will need to read the terms of your contract and see if you have agreed that they can deduct the money. If you haven't (and you haven't subsequently signed any other agreement) then they can't legally deduct this from you. If you have agreed it obviously they can, and I doubt they will take the extra hours you worked into consideration, however obviously if you needed to it wouldn't hurt to ask them.

ChablisLover · 19/04/2018 10:22

Frankchickens - I've found my contract and it mentions nothing about repayment. Can I now argue the point?
