Sorry, posting in AIBU for traffic, I don't know if I can even complain.

A week ago, I was in a supermarket and fell onto my bottom whilst carrying DS in a sling.

He screamed but wasn't hurt. I was in a lot of pain, lower back and bottom.

I was helped up and got a firm apology from the manager, I believe. Then I went to A&E with my MIL because I couldn't walk properly/stand up straight.

Turns out it's Saxr

The treatment is a review with a Dr and Physio, and strong pain killers.

I was looking to return to work but can not attend any interviews due to this.

I work for the NHS in London but can't go back to that position due to travel and finances. I was looking for a position closer to home before being due back but now cannot do so.

It's extremely challenging when my DH isn't here during the day and I'm looking after a small child.

I'm in agony Sad

It would very much depend why you fell. Was it due to something they had done (or hadn’t done) or just one of those things?

while I tripped because of a spillage, I believe.

It was a wet spot anyway, the fluid was clear so I didn't see it

What did you fall over? If you just slipped and the company were not negligent you have nothing to sue for. If the floor was wet and there were no signs you have a case. It all depends on the scenario.

Did you report it? Shops accident book filled in? I did the same and it was hard to prove without that evidence.

Probably not. The same happened to me in a Morrisons store. I slipped on a massive spill of some sort of thick, oily liquid. I had witnesses, I couldn't walk immediately, DH took photos of the spill and staff came over, provided me with a chair and got me into it and filled out an accident form. I went to hospital and I have a lower spinal injury which has progressed into my legs as a direct result.

It was suggested that I made a claim for negligence (I have now had to stop working) and they denied everything, despite evidence. The solicitors couldn't go any further with it and it went nowhere.

It depends on how you slipped, I suppose, but they didn't seem to care about that when it happened to me.

I'm no expert. However I'd agree fully with pp it depends how you fell. If you accidentally tripped over your feet then that's not the shops fault. Thst could have happened anywhere. However if you tripped over something blocking your way. You may have a case.

You’ve got 3 years to bring a claim so personally, I’d wait and see how you go injury wise.

In the interim, you might want to send them a letter stating what happened, that there was no sign etc and asking for a response. They’ll then have to investigate (if they haven’t already) and inform their insurers which will mean that the need to preserve all evidence (CCTV, accident log, staff statements etc) is triggered.

I’d seek confirmation in your letter that they’ve informed their insurers

You would need to be able to show negligence - has the spillage been reported and ignored or had it only just happened and nobody knew?

Oh sorry I didn't see your update. It seems to me they were to blame, then. If there was a spillage with warning signs up.

You can't sue a business for injuring yourself inside their store unless it was their fault.
Was the floor wet? Food on the floor? If so were there wet floor signs?
They will have CCTV throughout so if you just lost your balance then that will be clear on the camera

I know someone who sued a large supermarket after she slipped on the floor, not sure of the full circumstances, she was badly injured, it took years, but she did get a small pay out in the end and a lot of treatment paid for by them to help her recovery. A lot of the payment she received went to lawyers though.

Check your home insurance policy. Some include legal advice and support, depending on the issue.

A spillage isn't necessarily their fault. It depends on a lot of factors such as who spilled it, if the shop were aware of it, if it actually was a spillage or something like leaking equipment which they knew about.

You need far more information before anyone can say if you can or should sue.

I don't know if they knew about the spillage or not, for sure. They claimed they didn't, at the time.

It definitely wasn't leaking
Equipment, seemed like water to me

The knee jerk reaction to sue for something like this illustrates everything that is wrong with our society.

Chances are it will get better with time, it’s only been a week.

First off, get home insurance! Secondly I would write to them reiterate the incident and the ongoing issues it's causing, give dates etc and see how the injury pans out.
