First sick day in two years. AIBU?

Have been in my job for two years, it's a dead end minimum wage hell but I work hard. I'm punctual and I've never had a sick day. Last night I was suddenly sick at home. DD had a bug like this recently and wasn't fun.

Anyway. Up all night. Not well. On the rota all day today doing food prep but that's obviously a terrible idea. I called in sick as early as I could (as soon as there was someone there) but have been told it's a busy and they can't cover me.

Aibu to think that's not my fucking problem? And really if they want someone who is infectious preparing food then I should leave anyway? Manager has threatened to take my hours if I don't turn up. I've made it clear I'm in bed and unwell.

So you've now lost your hours? Because you're not going in due to D&V.
Fair enough, lets see him cover all your shifts from now on.

Start looking for other jobs & compose a letter of resignation explaining why you are leaving.
Send it to H.O. and copy your manager in.

they won't want you taking them to a tribunal.

The employer is behaving appallinger, but not giving hours to someone on a zero hours contract would not be a valid claim at tribunal.

Tribunals have in the past sided with the employee. It depends on her history but if there's a regular rota, and she works it then they suddenly stop because of this, a tribunal may side with her.

It depends on the people on the day, but it has happened. She's zero hours, but she still has rights. If they stop her hours and then dismiss her she can still say it's unfair dismissal etc.

If it is Spoons, I know they make a big issue of kitchen hygiene It's worth reporting your manager, they wouldn't be impressed.

Report them to Environmental Health. An EHO going down and having a word about their sickness policy might do them the world of good!

Yanbu. Don't go in. This may have an impact on your hours but you don't plan on staying there much longer, do you? It sounds a bad place to work, where your hard work isn't rewarded at all. This could be the tipping point for you. It's always easier to find another job when you already have one. Keep going to work once you're better, but in your spare time look for another job. You don't want to be stuck in this place

Good grief - please name and shame them on here! I would LOVE to know where it is so that I can avoid eating in a place that tries to bully vomiting workers into doing food prep!

And yes, report him to his bosses and to the EHO. If he is so badly organised that he cant cover you then he is bad at his job.

I'm zero hour but have the same regular hours, manager has form for taking people off rota as punishment.

Didn't go in, have heard nothing.

Has your manager texted that threat to you? If so don't delete it. If your hours are taken from you directly as a result of failing to adhere to the hygiene standards and guidelines I'm sure HR or environmental standards will be interested in someone instructed to attend work and prepare food with D&V.

Personally I'd turn up as your boss basically demands. If people get ill, it will be because of your manager's attitude, it won't be your fault.

If you can't get in because your illness means you are physically unable, make sure you keep a log of what was said and when. You will need it when your manager reduces your hours or otherwise discriminates against you.

With environmental health - could you do it anonymously? And leave it say 3 or 4 weeks before reporting? Just to avoid it coming back to you and further repercussions on your part

Appalling of your boss. It’s indicative of a really shit culture. Your boss is probably under massive pressure from above him, and so on. I’d change jobs as soon as you can and name and shame the bastards... I’d love to know who they are!

Some people have crap immune systems and D&V could make them seriously ill with complications. The OP has done the right thing by not going back in, I echo previous posters that the OP should go above his head. If this is her first sick day in two years, I think HR would know that she’s not taking the piss.

I would go in, and announce loudly and frequently that you have D&V and have been prepping food in the pub's kitchen - then see how fast they send you home!!

Everything is done through whatsapp for staff, have sent a message to that and to manager confirming I won't be able to attend until 48 hrs after symptoms have stopped as per guidelines. I could report to environmental health but it would more than likely get back to me, I sadly need the job as it fits around childcare. Looking for something else.

Right now I'm enjoying horrific acid reflux on top of everything else and getting ready to pick up DD. Who I'm sure will be the next to have this bug.

You've done the right thing. Have you considered taking this up with a regional manager? One of my friends does troubleshooting for TKMAXX and always says the staff are fine but the management in the crap stores are terrible.

I thought this would be Wagamama as they make staff come in and prepare food even when they have had D&V. DN used to work there and said the managers would be really threatening if you said you simply couldn't drag yourself in chundering.

It makes me reluctant to eat out if there are lots of chains like yours OP. Flowers
