Honestly not sure if IABU or not here.
Diagrams and photos attached Grin
NDN wants to 'finish off' the fence which currently divides our houses.
The fence was like this when I bought my house 2 years ago and I haven't really thought much about it but now I want to build onto the back of our house and realised it appears like NDN has 'taken' some of my land!

What's the MN verdict? And what should I do next?
The house next door is housing association, if that makes any difference.

Op, our neighbours have done the same (taken a small part of our garden with a fence in a terraced house).

I'm not bothered as the cost of rectifying it to receive more garden which would then need to be landscaped and maintained just isn't worth it. I also want to get on with the neighbours.

Does it matter that much to you?

blonde if she was going to build at the back of the house the party wall would be astride the boundary. The location of the fence has no bearing on this.

A party wall agreement would be needed with the housing association for this however.

I'll call the HA tomorrow, and if there are any problems I'll try the RICS, thank you all for the info.

As a complete non expert I would expect the boundary to be the midpoint of the dividing wall between the properties and then directly out from that. Especially as the plans don't seem to indicate anything otherwise.

Looks like they have had the fence posts put in where the actual fence should run. They installed the fence and if it's incorrect they have to fix it.

Can you try and search for any historical google street view pics or similar? Some people do try to land grab when the house next door is vacant.

Well I've emailed the HA and they're going to get back to me once the legal team have looked into it.
CFNDN has put up fence posts in my garden now Shock so I've told him he is NOT to come in again and leave everything as it is until we know what's what.
He's not happy, accused me of threatening him, being childish, said it's my responsibility, I should speak to the police Hmm
I've put a lock on my gate now and await a reply from the HA.

Have a look on Google Earth OP or even Streetview - the pictures may show the original fence or other boundary structure in a different place as they don't get updated as frequently as the Streetview ones which show the houses from the street. I'm wondering why the bottom section of shared downpipe is entirely in next door's garden for starters, and why it has been boxed in if that wasn't done in order for the original fence to follow the party wall line of the houses.

From your initial drawing and the fact there was a shed at the end of the garden, I'd say the property line was from where the shed was and your CFNDN did steal a chunk of your garden! I'm glad you're getting the lawyers to look at it. I don't understand people - did he actually think he'd get away with it?

Can you measure the interior of your room from the edge of the window frame to the wall and then see where that would come to relative to the fence ? It looks like it's only half a brick outside on the ground floor so if it is more than that inside it would be in their side of the boundary which would be wrong .

It looks very much like he's stolen a chunk of your garden. Get some string from the mid point of the drainpipe to the back of where the shed was. That will be your boundary line. then take a photo and post to MN showing how much he stole

Ah no the mid point of the windows not drainpipe as it looks from your first photos as though the drainpipe is slightly on your side so the fence can be nailed to the mid point of the windows.
