Parking ticket

This is a more WWYD. I will go with the majority vote here.

I run a business park and it consists of 1000 plus parking bays paid for by individuals on a monthly basis. Parking attendant ticketed a car that had no pass on display. Owner contacted me to state. Apologies I didn't show pass but I have a valid one so can you write the ticket off. Fair enough I think. Then it happens again the next day. So another email blaming the attendant for not recognising their car and I should write it off again. The attendant absoloulty did the right thing so no bashing. Just asking. Should I wrote off 1 or 2 or none. The rules clearly state to display your pass at all times. Many thanks.

I think you were generous to write the first ticket off. The driver knows they should be displaying a valid permit so they have no excuse.

One maybe write off..no way for second one. Surely the ones are displaying the ticket. Why arent they if they been caught the day before. Are they sharing the ticket

Thank you all. I feel much better for my decision. I will advise her to appeal the second but will assist no further.

Agree. Write off the first ticket but not the second. Is the driver expecting the same attendant every day; forgetting there will be sick days, holidays, new staff etc. His/her thinking is flawed!

Hmm I’ve had this exact same scenario but on much smaller scale. I have a designated parking bay at my block of flats- I’m the only car parked in the car park as nobody else has a car, and the attendant will see my same car in the same space every day. I forgot to add my pass twice and got ticketed both times but pitched that they KNOW I have the pass and they must know my car so ticketing feels cruel.

But for a 1000 car space I’d personally allow one error but would write off a second after a written warning that if this happens again then they will be ticketed.

Crabby.....yes its the same attendant but the attendant patrols many car parks. They can't be expected to remember every car.

I agree with writing off the first ticket but make clear that this is a discretionary gesture/ gesture of goodwill as the driver was still in breach of the term obliging them to display the pass at all times. Otherwise they might appeal the second ticket on the basis that the obligation has been waived.

What were your financial losses and how much is the ticket?

Can you post up the terms and conditions signs that are on display?

Fail to see how a solicitor or any one else can advise without that information.

Well it really comes down to what your published rules say doesn't it.
Do you still are how many you can cancel? Is it 1 ever? Per month? Year? 10years?
You have shown you are able to cancel tickets in these circumstances and unless you have written rules stipulating how often you can do it (and supplied these as part of the permit/contract to park) I think you are going to have to keep doing it.

Sure it wouldn’t be difficult for the car owner to display their pass as required?
