he won't give me my money back!

I brought a waist trainer from a market stool was from Columbia so meant to be good cost me 40 pounds this was on Sunday
today it has broken i took it back and guy on the stall won't refund me just said to take another one which I don't want
do I have any rights?

Dalston market is absolutely full of con artists advertising something as something else, in all honesty I’d be extremely surprised if you got any money back

  1. Waist trainers, broken or not, Colombian or not, are a complete and utter waste of money.

Conclusion: that's 40 pounds the OP will never see again. Time to move on.

Sorry, the Consumer Rights Act 2015 replaced the Sale of Goods Act 1979. My post was out of date. It's definitely nothing to do with the Trade Descriptions Act, though.

1. When you buy from a market you are realistically not going to have the consumer rights that you are entitled to under the law. (Unless you get the seller to give you a receipt maybe.) Caveat emptor.

That's what I thought initially but things seem to be changing and market sellers are being held responsible. Customers could complain to the market managers who won't take kindly to sellers not abiding by the consumer rights act.

The OP absolutely has the right to a refund for a faulty item.

However the burden of proof for the transaction lies with the buyer.

Without a receipt the OP has no chance.

Maybe that's worth a try. However: OP, if you do get your money back please don't waste some of it on another one. They are completely useless.

Agreed. I'm talking about whether that translates into reality. In the case of buying from a market - I doubt it (albeit see previous posts).

I also doubt we have any rights buying online from outside the EU.

Nothing ventured, nothing gained. I have had a refund from a market stall without a receipt, although the item was only £5.

At my local market, most of the sellers are very regular and I don't think they would a bad reputation. They do provide an exchange. But I have to say, I don't take an exchange or refund for granted, as I do in shops.

If you do want your money back, maybe mention reporting it to the police/trading standards to check it was a legit product.
