I have been in the process of selling my flat since the start of October and was ready to exchange but my buyer pulled out today Sad 4+ months after making the offer. I have all her contact details and am practically sitting on my hands to stop myself from sending her a message explaining exactly what kind of low life I think she is. I know it’s not worth it Angry

I think 86 years is a bit short to be fair, but its like you said, this isn't information that's just come to light is it. It's a horrible situation to be in.

That’s awful windy, I have also paid out twice on surveys, it’s a shared ownership flat i’m selling so I had to pay £500 for a valuation and i’ve Paid £800 for a full survey on the place I was buying, god, I hope I still AM buying! I haven’t heard back from my vendor yet to know whether she is willing/able to give me time to try and find a new buyer. I’ve also lost my flat mate now as he moved out thinking my move was imminent when I signed my paperwork so i’m losing that monthly income as well, not to mention the cost of the solicitors.

Yes, you can pull out in Scotland these days. I don’t know if it was ever illegal to do so, but I know it was very much considered ‘not the done thing’. However, over the last 10 yrs or so, this seems to have changed and people can and do do this. Last time we sold we threatened to pull out of the sale as the buyer was dicking around and we would have done it had they not signed the missives.

Hard lines OP, but as others have said you are coming into a great time to sell. Fingers crossed for you.

The flat is 13 years old. Both sets of solicitors have confirmed 86 years is not short. And the valuation takes the length of lease into account

Ah..86 years is quite short especially if she plans to sell again in the near future. You'd struggle to get a mortgage for a lease less than 75 years so she would face problems trying to sell it on, unless extending the lease was a reasonable cost.

I'm on the other side, we're trying to buy and went over our budget for the final offer by £10k, but after the full survey has highlighted a LOT of problems, we've asked for a £20k reduction or we're withdrawing our offer. I'm not prepared to buy a money pit!!

It's just business. I'm sure your former buyer had their reasons,If you've had one buyer, you'll get another. Move on.

Also, you never know, she might rethink tonight or even next week! (Wouldn't blame you if you stuck 5 grand on the price just for her though!)

I wouldn’t buy on an 86 yr lease. But I wouldn’t mess people around about it, either. Have you thought of extending the lease yourself and upping the asking price to compensate?

Yeah 86 years is a short lease. You have to live there for 2 years before you have the right to extend, and then she’d have 4 years to do it before it was sub 80 years, which is where it gets really expensive as there’s an additional fee to pay. These things can and do take longer than 4 years, esp if the freeholder decides to be a dick about it.

We bought a flat with a similar lease length BUT there was already a group action ongoing to buy the freehold and extend the lease. In the end it cost us £500 in legal fees to extend to 999 years and gain a share of the freehold, instead of the £10k+ it would have cost to extend the lease back to the original 125 years.

That said, I’m sorry she pulled out. Our vendors pulled out when we were buying this time. It absolutely sucks, I’m sorry.
