To ask how I send an email advising someone I’m taking them to small claims?

I posted before about my hair extensions going horrible after only 2 weeks and the hairdresser only refunding me for the price of the hair and not the application (around £100)

I’m not sure how to word it wouldn’t sounding threatening but I also want her to take it seriously

Can't you just do it rather than letting her know? Sorry, I don't know how it works, but is it necessary to tell her?

Chrys2017 · 05/02/2018 19:38

You don't need to advise them—the court documents will be served to them.

LolitaChi · 05/02/2018 19:39

I’d rather give her a final chance to reimburse me then go down the small claims route.

It is worth warning her so that she has a chance to settle. Google “letter before action”.

Blondephantom · 05/02/2018 19:44

I’d keep it simple.

Further to our conversation on x date, my extensions were not fit for purpose. I am unhappy with the refund of x amount for the hair as it cost me x amount including application.

I would be willing to accept a refund of x amount or a further application free of charge (if you are - not sure I’d let anyone near my hair after mentioning court)

If we are unable to resolve this I will have no option but to consider taking the matter to the small claims court.

Can you use a small claims court for this?

Poiuytrewq01 · 05/02/2018 19:45

WITHOUT PREJUDICE

Dear....

Having tried unsuccessfully in attempting to receive a full refund of £xxx since DATE, I now have no option but to pursue my legal rights through the Small Claims Court.

Failure to pay this amount in full & final settlement by midday on DATE means I will action my claim & you will receive all the relevant documents in due course.

Yours Sincerely,

Whatshallidonowpeople · 05/02/2018 19:51

Don't you have to give her a last chance to pay before you go to court?

Blackteadrinker77 · 05/02/2018 19:52

Did you accept the £100?

Can you use a small claims court for this?

Yes why wouldn’t I?
