If someone passes on your details...

A family member of an ex who we don't want to know where we live has started work at a place that has access to my details.
The ex has previously tried to get my details.

If said person accessed my details through the work database and passed them on to ex could I do anything about it in regards to his employment?

It would be a breach of the data protection act so you could complain and the organisation would likely take disciplinary action

NewYearNewMe18 · 25/01/2018 11:08

Yes you could, it's a breach of data protection - but be very sure before making allegations that could impact someones livelihood. If you are assuming that person passed on detail with no evidence, then the allegation is an unjust one.

DGRossetti · 25/01/2018 11:11

Can you change the details to add a middle initial, or a one-shot email address, so any leak can be traced ?

Awwlookatmybabyspider · 25/01/2018 11:11

Id say if thst happened you can report him to his work place.
Surely accessing records would be classed as serious gross misconduct and breach of confidentiality.

Can you contact the company now and ask them to lock or put a security flag on your file for protection? Maybe you can prevent any issue arising plus then the company will have evidence if the family member does try.

I was coming on to say this ^

I work regularly with social services and also health, and it's very common for a file/record to get additional security so that not just any employee can look up details when it's a known there's a potential to breech security in this way.

Contact the organisation asap and request. You probably won't have to go into detail

Good luck

Builderrage · 25/01/2018 11:15

I'm wondering that Swan but that would involve disclosing who the person is I suspect so that access wasn't given to them and I'm scared of doing so.

I have a slightly different known as first name but it's an obvious version of my real name and they know the town we live so wouldn't be hard to search.

100% against data protection laws, and the person would most likely get fired.
There is nothing wrong with talking to HR and asking for security to be added to your details, you probably won't have to give too many details.

GDPR coming in May now includes custodial sentences, by way of example as to how serious the ICO will be treating breaches, and therefore employers too

I would make a complaint just for the sake of it. I would have to be pretty sure where it had come from.
We have been pretty well protected for over 13 years and just want to ensure that continues.

What did Jimminy write as it was deleted before I saw it.

Wouldn't!!
I was just looking for advice on how to keep my family protected.

Think I will bite the bullet and call the company as suggested. Hopefully they won't want loads of details.

Thank you.
I absolutely won't make a malicious complaint.
As far as I know my details haven't yet been passed on as it is very early days. I just needed to make sure what to do to protect myself and my family and that I had legal backup should they do so.

Thanks will call them for advice.
