AIBU to ask whether any of you have successfully claimed against the council for damage to your car caused by a pot hole?

I've damaged my wheel tonight and to replace it and the tyre will probably cost £400... money I simply don't have.
I've done a quick google and it seems there is a process.

Have any of you guys successfully claimed?

Well.

Its taken me nearly 2 years but i finally have an offer of full repayment.

Its been a nightmare tbh. Did their original claim form. You have to allow 9 MONTHS for them to reply. They then said they werent liable.

I then did a freedom of information request and it turned out 2 vehicles had previously hbeen een damaged on the same pothole.

I pointed this out. They still denied liability.

I went through Simple Claims Procedure (scottish small claims) and when they got the papers they claimed that a cheque was issued and never cashed, they were so sorry etc etc.

Oh god thats so boring I'm really sorry.

The answer to your question is yes, but not without dicking about for the best part of 2 years.

I claimed against Northern Rail for a broken CV joint after crossing their rail way lines and slamming into a pot hole. Two weeks start to finish.

I'll brace myself for the long haul then! It just feels so unfair that I should have to pay because the road hasn't been longer led after properly!

My parents finally got a payout after 2 years. Dad is retired and just kept badgering with letters, it was a bit of a project for him. I definitely couldn't have seen it through as someone who works, I'd just pay for the damn thing (and feel hugely resentful about it!)

Sounds the same avocado except the parents are down in Surrey. Apparently it's awful everywhere 😐

I think ours(?) are only liable if they have been notified about the pothole. Don’t know how you’d prove that.

Was the pothole highlighted in paint? I think you can only be successful if the Council knew about it and should therefore be acting to sort it. This may show up online.

I'm going to go back over the road tomorrow but I don't believe it was highlighted... will do some more research tomorrow on whether it's been reported 😫

DH just had a look at it and said there isn't any obvious damage... that the 'beading' (whatever the fuck that is) May have been knocked out and it can be re-sealed.... here's hoping!

DH just reported one. Just cost him £400 to have his car fixed. Apparently you can only claim if the council knew about it and did nothing about it.

They need to show its inspected regularly (there are guidelines on how often different type of roads should be inspected) and they were not notified of the pothole prior to the damage to your car happening to be able to deny liability.

I got it fixed really cheaply in the end... friends brother got me a tyre for £35 so I'm happy!
