Fighting over parking spaces!

So.. we moved into our house nearly five years ago with little no probs before. There are six bays just opposite our house where both me and my partner have parked our cars for the last five years! As well as ourselves, our single neighbour parks his car there, as well as the middle aged woman who lives over the road and the last two bays are owned by a b&b over the road. Anyway,

Today random knock on the door. The middle aged lady who parks next to us is on the doorstep. Never had much to do with her before and never really spoken to her. She claims that she owns two of the spaces in that row and told us we are no longer able to park both our cars there.

My partner has got a copy of the land registry from a neighbour that also had parking issues and it clearly marks that only two of the spaces are owned - by the b&b owner as far as we are aware. The other spaces are free for all therefore she has completely made this up.

She proceeds to tell us that her teenage son is starting driving lessons and needs to be able to park when he passes his test. So it sounds like to me she’s just making this c**p to make sure her son can park his car. We didn’t argue with her but we are baffled.

These spaces should be free to all so a first come first served basis so if her son is in the space we will park elsewhere and vice versa.

It seems like we aren’t the only ones with issues with her. Our neighbour is friendly with the b&b owner who’s had major issues with her apprently and the police at point. She was claiming one of her spaces as hers so it seems like she’s just making it up as goes along.

Sorry for the long post. Any advice? She said she is going to mark the space out with her house number etc but she has no legal right to do this?

Shall we get a photocopy of the land registry and shove it in her letter box?

Is there anyway she could have bought these spaces that you are not aware of? I would check with land registry first.

Yes I would send her a copy of the land registry & ask the b&b owner to back it up with his deeds showing he owns the two spaces.

Tell her that you checked and unfortunately it turns out she's mistaken. And she should take it up with the seller of her house, if she was led to believe she owns the parking.

First of all, YABU as you have not provided a diagram - parking threads always require a diagram!

Does sound as if she is making it up as she goes along, I would ignore her but if you are worried, check your deeds against the land registry details which should resolve the matter (at least for you, as she sounds teh delusional type for whom fact and proof and evidence are irrelevant!)

Thanks all. The land registry only states that two spaces are owned - the end two. She claims she owns the middle two if I confused anyone.

The spaces aren’t available to buy anymore as far as I know. You only own a space if a space was sold with the house years ago I believe. The b&b owner was very fornunate in this case. I believe the property was used a a holiday let previously so I assume a previous owner had bought them for this.

She looked taken aback when asked if she’d seen the land registry (we have seen it previously when a friend on another road in the village had similar probs). I think she expected us just to accept that she was right.

She should provide evidence then that she owns two. Ask her for her proof.

We had something similar in a rental property and we had two different documents each saying we were right.

What the land registry document shows will depend on what property it was for so if you saw the B and B owner's copy it would only show the spaces that go with that property. You need to see a copy of the neighbour's house land registry document. You could ask her or download it for a few pounds from the land registry website.

Ask her to provide evidence to show that she owns them- if she can't then tough shit she's obviously making it up.

Say politely that you have checked with the land registry and the parking spaces (with the exception of the b&b spaces) are all free, and that unless she can prove otherwise you’ll continue to park there when they are free, and it will be - case of first come, first served.

It’ll be a pita going forward as you’ve got 3 spaces for 4 cars but that’s the way it is these days with more and more cars in the road.

What euro chick said. If the copy of deeds you've seen is from the b+b, it will only show the bits owned by the b+b. You need to see a copy relating to the property owned by the lady. It will either show just the house/flat or one or two parking spaces as well.

You should run a map search on the gov.uk Land Registry website to identify whether the other parking spaces are owned by anyone. Just because your title register doesn’t show you own any of them - and it’s not clear whether you have the right to use those spaces in your documents. The map search should show the different titles for the spaces although you won’t be able to see who owns them, just that they have different title numbers. Download the registers and plans for more detail.

Agree with asking her to provide written, legally binding evidence she owns spaces. Until she does that, ignore and proceed to park as you have been.

I would get a copy of her house's deeds and check them just in case it says something different to the one you've already seen.

The previous owners of my house bought the freehold so my house has 2 entries in the land registry (one leasehold and one free hold) whereas I'm assuming the houses that haven't bought the freehold would have one. It should show her ownership of the spaces if she's telling the truth. If not she's trying it on.

If I owned two parking spaces I wouldn’t wait five years before telling my neighbours not to park on them!

You could ask her or download it for a few pounds from the land registry website.

Or you could spend 3 quid and download them yourself, just to be certain.

I'm not a landregistry wizz, but could there be some way they could be listed separately?

Land registry was for the village as a whole. All owned parking spaces are outlined and numbered! 😊

I would be asking for evidence. Don't just say nothing and let her paint her number on the spaces. Nip it in the bud now.

Don't do anything. Continue parking there. Seeing as she is trying itvon she may not have the stomach to continue the farce. If she does then just show her the document and tell her that she was mistaken.
