Bear with me while i rant. bought a new kitchen and bathroom off b&q back in January,it was delivered a month ago.we have had many,many problems,some bits missing,some not in stock until June but thats a whole other thread.
The fitter we've used said he could do both the kitchen and bathroom,would just need to get a Corgi guy in to plumb in the cooker.He gave us a price which he said included all of the plumbing and elecrtics and he kept all of the plans in his possesion so he knew what was involved.once he started on the bathroom though i did ask if it would be possible to add a chrome towel heater and a few other accessories-loo roll holder e.t.c to the original plans and add it to the invoice which he said was fine.
from day one we have not been entirely happy with his work,he has managed to scratch all of our new benches and the stainless steel cooker,chipped one of the door units and completely ruined my oak dining table by putting a freshly boiled kettle on top of it,stripping the wood off. We chose a splashback in the same wood as the benches to go above our cooker which,when he has cut it has left hideous sratches on the edge,it was not a clean cut at all.to which his answer was to cover it up with scratch disguiser.the splashback was £100 so not happy but thought i'd see what it looked like.half way through the job,he asked for £500 which we gave him.
i don't even know where to start with the bathroom-we chose decorative cladding rather than tiles with metal strips going through them,(hope you can visualise them)which he has cut to short so we are left with gaps at the top.he has also put holes in the cladding,presumably with a screwdriver,which he has tried to hide with silicone.the accessories i asked him to put up are too high-the kids can't reach the toothbrush holder or soap dish.but worse still-he hasn't brought the cladding right down to the bath,there is a gap of about 1cm between the bottom of the cladding and the top of the bath.i asked him what he was going to do to seal it and he said silicone!!it looks stuoid-a 1cm thick band of silicone! what he should have done-i have consulted bathroom/tile people about this was EITHER bring the cladding further down so it sat flush with the bath OR not brought the silver strips as far down as the cladding(the strips are raised a few mm's off the wall)so that a standard bath seal could fit around.the final straw came when,after many,many attempts to get him back and him messing us around,my ceiling nearly caved in as the water has started leaking through where the bath seal should be.he rang me 2wks ago to ask for the rest of the money even though there were still several jobs left for him to do,just minor things like sealing around the sink,putting shelves up e.t.c and i refused to pay him the full amount till he was finished.he invoiced us and we found he'd added £80 for plumbing and £100 for electrics which he had originaly told us were included.the total bill minus the £500 he'd already had came to £1400.i said he could have a grand then get the rest when he came back to finish the job. he came back yesterday to do the odd jobs and to disguise the scratches on the splashback and supposedly sort the bath.i was out so DH gave him the cheque.
honestly if you could see the stats of my kitchen and bathroom.the splashback looks hideous,we are now going to have to fork out for a new one and pay someone to fit it.he hasn't finised all of the little jobs like siliconing around benches and as for the bath-well it looks ridiculous and is still leaking through my ceiling.
he has taken over a month now to do this,has been back and forth about 15 times,we have complained to him about 30 times and i am just so sick and want an end to it all,i don't want that pathetic man back in my house so i cancelled his cheque.didn't ring him i was too pi**ed off,just cancelled it.the one for £400 that is-he has already had £1500 out of us.

Cancel the cheque NOW!
You are legally entitled to do this.
You can get an expert in to see how much the job he has done is worth and pay him this.
Personally I would pay him the above minus what it is going to cost you to put it right.

I would phone your local trading standards and see what they say.

Take pictures of his work and all the damage he has caused.
Get an estimate etc and then raise a court action against him.
If he didn't pay up you are then entitled to send the baliffs round

Don't remember the detail, but I think he's in breach of contract if he has been incompetent or careless (this I think is sale of goods act (struggling to remember) - don't think his own T&Cs which he may have supplied you with affect it). It may pay you to get someone in to inspect (not sure who you'd get, it'd be a surveyor for building works). It would cost you, but if he decides to pursue you for the money you would have the expert's opinion to back you up.

Decide how you want this to turn out - sounds like you don't want him coming back to try and fix things. That's fine, but write to him, tell him you're witholding his payment and why (if you could get prices for rememdial work so much the better, then he can see (and anyone who sunsequently reads the correspondence can see) why he's not being paid). You perhaps will have to pay him some once you've worked out (with the aid of your expert, or with a quote from another fitter), then send him a cheque in full and final payment.

It's a long time since I had similar trouble (with building work). Do everything right, document everything, be fair. You can complain to trading standards and his trade association (if he's in one) if you can't resolve things.

The Watchdog page on BBC had some good advice and template letters.

the fitter was self employed,don't know if that makes a difference??
the total bill was £1900,he has been paid £1500 of it so we are only witholding the other £400.
