Eviction Process

Posting for traffic.

This will sound awful of me, and hopefully this will blow over in it’s own, but can anyone tell me the process that HA’s go through for evicting tenants?

A new tenant has moved into our building about a month ago, and he is quite obviously a heavy drug user.

A few weeks ago, he went round all the close doors at 5.20 in the morning looking for someone to tune his tv.

Over the last week, another user from across the street has had his windows put in, and now he’s a regular in our building. I know the HA are in the process of evicting him.

My 13YO DS has met this one twice coming into the building, one of the times he pulled a clear box of white powder out of his jacket. (I’m told this was probably sugar, for prepping himself before injecting).

I saw him myself last night and he looked like absolute death, being put out of the local shop, and lo and behold, made his way to my close again.

A neighbour told me he’s seen a third user in the building as well.

Apart from the 5.20 tv incident, the actual tenant hasn’t done anything else that I’m aware of, but I googled him and he has previously been in jail for a month, something about a noisy party and giving grief to the police when they turned up. My main concern for now is all the comings and going’s. My son comes home on his own after school and I hate the thought of it now that he coming across these people. If the guy across the street gets evicted, he could be here every day.

If things escalate with the new tenant, what’s the procedure for the HA, and how long does it take them to move them on?

I know a lot of the neighbours have complained already following the tv incident, and so did I once I realised this other guy was involved.

I’m the only one in the building who owns my flat, and I’m now stuck here for at least 2.5 years. If this keeps up, no one will want to buy my flat anyway!

Sorry that was long, and I hope you don’t think I’m awful wanting this guy out my building, but it’s really playing on my mind.

It can take some time. If he's breached his tenancy agreement, then notice will be served (couple of months), if he doesn't cooperate then the landlord will have to go to court to get him evicted and will then need bailiff if he doesn't comply.

Even if a tenant behaves appallingly, the LL doesn't have to evict them.

Best thing to do is call the police.

Sorry but that just isn't true.

Even if a tenant has breached his TA, the 'LL is under no duty to evict them.

I do think the HA take it seriously though. When I called they were aware and I had seen two HA officers in to visit him after the tv incident. My neighbour said they’ve been in twice.

I’ve lived here 11 years and never really had any trouble and the HA do follow up on complaints.

I’m in Scotland if that makes any difference.

The HA may talk to the tenant but eviction is the very last thing that most HAs will do.

The HA can go to court to evict easily, whether they will is another question.

Persian, I know that but if the HA has grounds for eviction and wants to evict them then that's the route they should follow.

It can take some time. I work in social housing (although not directly with this sort of thing). I know the HA has to work closely with the Police to get someone evicted for drug dealing. Probably best to speak to the HA and ask them to explain the process to you.

I know how HAs work and i know how bad tenants should be treated.

I also know just how seldom they actually take action against bad tenants even though there are people waiting for properties that would be model tenants.

Do you know if the HA gave this tenant an introductory or starter tenancy?

Some do and some don't.

Also, do you know if this tenant was already a tenant of this HA before renting this particular flat?

No, they are in the process of evicting the tenant from across the road who has started visiting the one in my building.

My neighbour told me that and the then guy at the HA confirmed, saying if they were waiting on a court date.

Persian it’s crossed my mind. His own windows are boarded up just now and he’s been here at least 3 nights this week. Maybe he’d be doing that anyway. I don’t know.

I would talk to the HA if I were you and mention your concerns.

Yes, I’ve done that Persian, not much else I can do for now, I guess. I don’t suppose the HA can dictate who visits him, and he himself has so far only been “anti social”
on one occasion that I know of.

I’m meant to be having a sleepover of 4 friends for my sons birthday during the holidays and I feel like I can’t even do that with these people in my building.
