I have a problem at hand .We live in a 1 and 1/2 bed room flat with a very small living room and open kitchen plan .The flat above had a bioler fire and there is a water leakage due to this .The same came down to our roof and we had to call emergency plumber to fix it .He dug holes to save the whole wall roof of the living room but water is still coming out .The property management of the building cannot do anything because the bioler above needs to be fixed and the two landlords( shared ownership are not coming to any conclusion about it . My landlord stays in Germany and she cannot come here to fix all this up at the moment .I am acting now like a agency for my landlord and trying to fix up things .The concierge says he cannot do anything but wait for the landlords to solve this .And so we are left only with two bedrooms to surivive in this chiilling winters with the sofa etc and toys of my child to be kept inside the bedrooms ( which were kept outside at living room ) .I am really depressed and angry and today my DH tells me to act like a mature person .AIBU to atleast get angry and frustated for DH doesnt even stays in the house at the moment and is out at work for the whole week and its me who has to look after this .What can I do ?

It's surely the responsibility of the landlord upstairs. Your landlord needs to instruct a solicitor to write to them immediately.

You have a concierge, a landlord AND a property management company and they are all saying they cannot help? Shock

I don't think board would be au fait in German property 7/or insurance laws?

Groovee · 19/11/2017 17:39

The person up above is responsible for your repairs as they are the cause of the leak.

gg1234 · 19/11/2017 18:27

Your ll needs to contact their insurer (which may be communal if the property is a block) and ask them to make good the damage. If needs be they in turn will claim from the flat above's insurer. Is the water now turned off above? If your possessions are damaged your contents insurer should cover it.
