Boss says i only have 5 days holiday next year, all year!!

Hello lovely mumsnetters/my own personal employment advisors Grin

I work 3 days a week (just changed hours when i came back from maternity leave at the start or september)
I work monday wednesday friday as thats what i was offered because it covers everyone elses days off.
My boss said he used to gov website and my holiday entitlement is 16.8 days (he is right) he then said i have to take the bank holidays out of that and save 3 days for christmas.
That leave 5.8 days holiday for a whole year, not even two weeks.
Is this right? It seems really unfair the lady i work with also only does 3 days but a monday isnt one of them and she gets all hers (except christmas so 13.8 days) to play with.
I feel like im being punished for working a monday Sad

Actually hobbes is right if the three days at Christmas are the three between Christmas and NY you'd only be down to work two, so in fact you should have 7.8 days next year which gets rounded to 8. Which is better than 5!

also check that others have to take their BH as holiday too

Christmas 2018 might be a bit unusual because I can see a lot of office type businesses closing from Friday 21 December and not reopening until Weds 2 January as many people won’t want to work Monday 24 December.

So the OP would need holidays for Monday 24, Weds 26, Friday 28 and Monday 31 but this would cost the 3 days off her allowance because of the need to account for Christmas Day, which falls on a non working day for the OP.

However, there doesn’t seem to be any round the situation unless the OP is allowed to swap things around so that she doesn’t work so many Mondays, either as a standard working pattern, or on occasion throughout the year – OP is it worth asking if any of your colleagues are interested in working a different pattern and seeing if your boss would agree to this?

But it's incorrect to say that you're missing out on holidays or getting any less than your colleagues. Just that you have less choice about when to take them because of BH Mondays.

Years ago when I worked PT they didn't have this system, you got the bank holidays AND your holiday entitlement pro rata. It seems that the part-time worker legislation has actually had the opposite effect to what was intended.

One option for you OP is to suggest that in the weeks where there are bank holidays you will work an extra day so you get the BH back. So for example, you could work Tuesday instead of Monday. A few years ago I worked with a lady who only worked Mondays and Fridays so she did this, as she'd have never been in work otherwise (slight exaggeration, but you get what I mean).

This is a screenshot that is what my boss os going off, he works it out the same for everyone and oyr contracts read "you are entitled to x amount of holiday days including all bank holidays"
People who said i only have to save 2 for christmas are right i didnt think of that and yes christmas day is a tuesday so will get that one back as well taking me to 8 days leave i guess thats better than 6 😦

So if you get 8 days to use as you choose, and use them in weeks where there is a BH Monday, that means that you get 4 weeks leave, just like everyone else Smile.

But you still do receive the same amount of holiday, it is just you have less flexibility of when to take it - as in you do still get those 7 bank holidays off paid , rather than being in work. Or am I being a bit thick?

I don't want to repeat what other posters have said, but my old employer used to take 3 days for Christmas. I said I would work instead - no commitments at the time and didn't want to sit at home bored during the interim holiday period. I worked in a lovely quiet office and had hol when I wanted it - would this suit you?

Not very flexible for you but as PP said, if you take your days off in a BH week, you only need to take 2 off and you can do a week's holiday.

With regards to changing your days - it's done by negotiation. The business was ok with you going part time as they were able to have you work Mon, Wed, Fri. It wouldn't suit them for you to do any other days hence they haven't agreed to it. If you started not turning up on the agree days then surely that would merit a swift disciplinary action.

How many days off (including Public Holidays) does an equivalent full-time employee get per annum?

How many hours per week does an equivalent full-time employee work per week, and across how many days? Do they work the same number of hours on each of those days?

How many hours per week do an you work per week, across your three days? Do you work the same number of hours on each of those days?

Does the company/place of work close on Bank Holidays, or do some part & full time equivalent employees work?

Ooh that sounds stingy. I work Mon Tues Wed with 18 days leave. Bank holidays are on top of that, so I have 6 weeks plus any bh that fall on a working day. So Monday is a good day to work!

When i was working part time. I was doing 25 hours a week. I was still entitled to 4 weeks off holidays, same as my full time colleagues. One of those over Christmas which i had to allocate 2.5 from my 10.5 yearly holidays entitlement. The difference been I would get 20 hours per week pay while on holidays my usually 2.5 days pay with my normal days off.

I did not think bank holidays were taken from annual leave.

They merged the two. It used to be 20 days plus bank holidays, but that was unfair to people who worked on weekends or whatever, so they made it 28 days including bank holidays. So now everyone gets the same amount it's just that if you work on, say, Mondays, then you will have less choice than people who work on, say, Tuesdays.

But in general the company can dictate your holiday dates, they have to give you paid holiday it's just up to them when.

Where I work everyone HAS to take 10 days over Christmas. I'm full time now but when I was p/t & worked Monday's it left me with very little.

He's right in that you have to give some of your annual leave towards Bank Holidays, but you do also get BH pro-rata as well, so if you are working 3 days, i think it will be 2.5 days you get, and the rest you have to give through your annual leave.

*don't quote me on figures, just trying to give you an example.

When i came back to work after having DD, i worked 3 days, Mon-Wed and i had a big argument about BH's. Ring ACAS they will explain it all to you x

But you haven’t got just 8 days holiday. You’ve got 16.8 days. Bank holidays are holidays too!! It’s just that they’re fixed, along with your Christmas shutdown. No one has the legal entitlement to take their holidays when they like. An employer can, if it wants, fix all of their employees holidays!

You should have leave (pro rata'd for your hours)
You should also have your Bank holiday allowance pro rat'd and this is where your Bank Hol Mondays and Public Holds should be taken from.

It's also easier to work in hours rather than days if you're part time.

Well you don’t have to save 3 for Christmas surely as that applies to full timers?

You get 17 days. In 2018, 1st Jan is a Monday, plus another 4 Monday’s, Good Friday and Boxing Day will be on a Wednesday so you have 10 left to play with.

You will then need to save 2 for Christmas (Friday 28th and NYE) assuming you work on Christmas Eve.

It’s worked out badly for you but it’s completely fair. The only thing you can do is offer to work on a different day on the bh week or use to your advantage and take off two to make a week.

Or have al the bank hols unpaid and take them elsewhere

You won’t get Christmas Day back. Your 60% of BH entitlement includes Christmas Day. If it was a Monday, wed or fri you would have to allocate a day for it from the 17 days. As it’s not, you don’t. You aren’t entitled to it back
