They cannot fine you until child is five, someone in my dds class only went in the mornings until they were 5 (August baby) as the day was too long for a just turned four year old. They could not take away her place either.
My dd has a January birthday and we took a 2 week holiday in the December term before she turned 5, I emailed the Lea and asked about it, no problem.

You can only be fined if you commit a crime, go to court, get found guilty and the judge fines you.
This is incorrect. You don't go to court to receive a fine.
You receive a fine through the post. If you don't pay it, they may decide to prosecute in which case you will go to court.

I think your comment MyDc must have been aimed at a different poster.

I didn't refer to when a DC reached CSA, simply that OP's DC (who is described as not yet 5) has not. Because if is, of course, term following 5th birthday - assuming OP is in England.

And a child who has not reached CSA cannot be fined (as I said in my first post), but can trigger other attendance management measures. For the reason I stated - it is optional to enroll children before CSA. But if you choose to do so they are expected to attend regulary.

No I was responding to yourself meditrina. No attendance management policies apply to a child below csa.
