WWYD about this washer?

So, for years I rented my washer (or rather a series of washers, they were never new) from a one-guy firm. He used to be really good, if it broke, he'd be out the next day. Over the years I think he must have gotten more successful because you can never get a hold of him and when he does turn up it's because he's been on holiday. For a month. Again. That's not my problem, nor my business, I'm glad he's doing well.

But, in May, I was given a washer. Which was going to save me a few quid in rental a month. So I texted the guy and asked him to pick up his washer at his earliest convenience. Then again a week later. I finally texted that I was going to stick the washer in the insecure shed. He finally texted back that he'd been busy and get it the following day. This was in June.

The washer is still in my hallway. I sent him a text last monday asking if he actually wants it back, no reply. Now I know someone in desperate need of a washer... there's a solution here, but it's not entirely legal or ethical, but on the other hand, I want my hallway back.

Give it to them!

Are you still paying for it? If you are then stop your payments and I'd imagine you will soon hear from him!

Ask him if he still wants it. If he does, give him 7 days to collect it, otherwise you'll dispose of it.

If he doesn't want it or doesn't collect in 7 days, give it to the person that needs it.

Penny4UrThoughts · 10/09/2017 14:29

(I'm not sure if that's legal, but he's had plenty of time)

I would just give it to the person who needs it, on the proviso it's a loan from guy above. Then if you don't hear from him (and have tried a couple of more times to get it back), it's theirs to keep.

So another text saying that he's got 7 days before I get shut? I'm just hoping he can't do me for theft or something if I do that. I think I might keep his and give ours to the person, then if he should decide to sue me or something, he can have it back and I will go buy one.

DD1 rang him today and said that if he didn't collect it this week, I'm putting it out for scrap. He said he's coming tomorrow. We'll see.

I would be cautious. If you dispose of it without express written consent you could easily find yourself legally obliged to pay for it. A telephoned or texted ultimatum is unlikely to change that. You'll need to be sure of your legal position.
