I sold an item in good used condition. A lady collected it told me she loved it and it was in her words perfect. Later that evening I recieved a lot of angry messages from her, claiming the item wasnt in good condition, and she wants her money back. Before I even got a chance to reply she had left me really nasty feedback. I told her it was sold as seen and she was happy with it at the time and it was a used item so she can't expect it to be immaculate but she did have a chance to inspect it. She is now threatening to take me to court! Wibu for not giving the money back??

YANBU. She won't take you to court.

Sold as seen, is just that I would reply saying you will not be engaging in further discussion and you will await the court papers (the courts will throw it out before it even reaches the need for you to turn up, that is if she even bothers taking you).

What ever you do, don't give her the money back, leave her to argue with herself she will soon get bored and move on.

I had a similar situation, I sold a Nescafé coffee machine - perfect working order. The lady collected it all fine, the next day she commented on my original post saying it didn't work and I had ripped her off. I was furious! It worked perfectly and I thought she may have broken it and was trying to say it was like that when she collected.

Long story short my husband went to collect it and gave her money back - I really couldn't be arsed with the shit we were getting. Once home we recorded the machine working perfectly and put that on the post. The next person in line bought it no problems.

The woman ended up getting herself banned because she called me a sly cunt and said that it was a different machine, it wasn't.

So for me yes, I probably would refund and then resell the item.

Just to point out it's not an item that can be broken as it wasn't electrical or anything (don't want to go into too much detail incase she's on here!)

Tell her you look forward to the Court case. Keep everything she writes to you.

Some people just try it on. I sold a brand-new Boden coat on Ebay that had been donated to our charity. Buyer claimed that it was a different size to the one advertised, that she'd wasted money on dry-cleaning and was devastated that it didn't fit. I told her to return it and I would refund the cost of the item (I think she wanted the dry-cleaning cost refunding too) - it never arrived. I think she was just hoping I'd refund and let her keep the item. Did put me off selling on Ebay though.
