AIBU to move now? LL to give notice

LL has told us he is looking to put house on market. It sucks because we only moved in a year ago when he told us he was looking to rent it out for 5 years +.

We put a lot of effort in to making this house nice. It was in a horrible state when we moved in, we've deep cleaned carpets, re-decorated throughout and landscaped the garden. (All with permission.)

I feel resentful and don't want to be paying him rent anymore. LL is hoping to get these rent payments up until the day he sell (he's told us this). AIBU to move out now and let him pay his own mortgage for the time it will take to sell?

Don't cut off your nose to spite your face, but if you find somewhere suitable, affordable and hopefully maybe even better then don't give his mortgage a second thought.

It's very likely he'll sell to another landlord, surely? That's what usually happens when you've got tenants. So you'd be able to stay there - your lease binds the new landlord.

That depends surely on the tenancy. Mine is a rolling one now, after the first year. I think my ll only has to give two months notice (as would anyone he sold to).

How long is on the lease? Have you had a section 21 yet?

We've not had a section 21. We don't have a tenancy agreement, it was all done verbally. So I'm guessing it is the statutory 1 month from us, 2 months from him.

I realise he might sell to another landlord but that means having to live in uncertainty for x moths whilst he's trying to sell.

So fed up with renting!!!

You would be silly to move only to "spite" him. If the house is empty, he will sell a lot quicker anyway. You can either stay until you know if the buyer is another landlord, or start looking for something suitable. You are not in a rush.

I don't think so no, I've rented out three properties and none of them I have sold on to another landlord. There is nothing to differentiate a rental property to one folks own and live in.

We were renting and the LL decided to sell but wanted us to stay on until he'd completed on property once he had a buyer. It's awful to live under those circumstances and uncertainty was very unsettling so we found another (much nicer property), gave our notice and moved. Do what suits you, not your landlord.

I managed to do this. It was lovely.

Our agents/LL messed us around - they insisted on repainting to sell at a highly inconvenient time, so I had to practice for an interview in a stinky-paint smelling flat giving me awful headaches. Then when it DID sell, they didn't have the decency to tell us (I found out online).

I found a new place in three days, and we were out in five weeks. Landlord missed out on nearly three months rent in the time to completion and we went with a different letting agent Grin

Why do you not have a contract??? Hopefully you have not paid a deposit to this LL because you can bet it won't be in a deposit guarantee scheme. Yes, by all means move if you can but that depends completely on having somewhere to move to, doesn't it? There is no point in flouncing off and then realising you have nowhere to go!

So he has not lodged the deposit as legally required? Then put in a claim and get compensation.

We have not paid a deposit.

Obviously we would find somewhere else first but there seems to be plenty advertised at the moment so won't be a problem. We will find something we like and then move.

What I'm not gonna do is stay until it sells just to be nice.

For future reference ALWAYS get agreements in writing, it saves a lot of hassle in the future - even if its a private rental. Verbal agreements can be changed to suit either party.

Oh, if you've not even given them a deposit then I would just look for something and move.
