To expect neighbour to communicate scaffolding work

Neighbour is having an extension, didn't find out until scaffolders turned up asking for access as neighbour was at work. Builder was really rude and accused me of wasting his time as I was unsure about giving access as I hadn't been told anything. Also the extension work will be right outside of my front door for god knows how long. Still no word from neighbour and builders turned up on Saturday. Scaffolding is now all up. I always give weeks of notice to neighbours for anything happening.

You don't have to agree to access.

Rude builder would have been sent off to wait until I'd had contact with the neighbour. So much scope for damage to your property, allowing access to a company you have no proof of wouldn't happen here.

My neighbours did this and I was furious. Told the builders to get their scaffolding off my property and to keep it off. Was proper angry in the street and everything.

They had stuff bolted to the front of my house! Not for long ...

I've never quite felt the same about my neighbours. I thought they were really cheeky. Anyway, DP ended up going in with the foreman to inspect the works because they affected a joint firewall, and some sort of peace descended.

But I'd never not warn / ask a neighbour.

I was worried about them being arsey or causing problems when they came back once neighbour had let them in during the works period

Are you attached to their house? Do you not need a party wall agreement?

coffeecuppa · 31/07/2017 20:45

I was going to ask the same as toomany. If they are doing excavations for foundations or doing anything that affects your party wall then if they have not given you Notice they are in breach of the Party Wall Etc Act 1996.

So many twatty neighbours do this though. They tell the builders it's 'sorted' when it's not.

Surely he would have to ask for planning permission, dont the council send letters round all the neighbours asking for agreement before work can start?

In any case asking for permission for builders to put stuff up on your land would be the very least he should have done. You are perfectly right not to allow it until you know exactly what they are doing and how long for.

Do you mean that they have put the scaffolding up on your property despite you telling them to remove it once? If neighbour hasnt asked your permission tell them to take it and shove it where the sun dont shine. And dont be fobbed off by builders, they know the rules around this stuff they will just try to bully you into giving in so they can circumvent the law.
